Hi guys,
Not sure if anyone can advise me on this subject.
I have been stabled at the same yard for over 13 years. 3 years ago the lady who owned the yard sadly passed away and her neice inherited it.
A new contract was issued in January of this year and the new owner asked us to not only pay our livery a month in advance but to also give her a months livery as a deposit for each horse we owned.
I was given notice to leave in writing on 30th March 2010. It stated that I had 4 weeks notice, but to date, i have not been given a reason for the notice
Luckily I have found a lovely new yard and moved my horses on 16th April. I tried to make arrangements to pay my part livery of 16 days and get my deposit back but the YO is now refusing to give me my deposit back, stating that the notice is 4 weeks and she wants paying for the entire 4 week period, regardless of the fact that I have left 2 weeks earlier.
The actual wording in my contract states that "4 weeks notice is required to terminate the livery contract from both parties" (Livery owner and Livery client). It does not state that this is paid notice, nor does it mention anywhere that my deposit is non refundable.
I'm really confused as to what to do next.
I moved my horses quicly because previously the new YO took a horse on to the main road and let it loose as she had asked its owners to leave the yard and only gave them 4 days notice, even though they had signed the exact same contract as me !
How do I go about getting my money back, if I am entitled to it of course ?
Any help/advice would be greatly appreciated.
