Need value for this horse for courts

16.1hh 6yo gelding by Capitol. Brought for a considerable amount of money as potention 3DE event horse. Due to problems apparant immeidatley after purchase court proceedings have been issued against the dealer he came from as he refuses to take the horse back. We need a current value please...... feel free. PM if you would prefer.

He is a severe headshaker, currently totally unrideable with video evidence. Has not responded to any headshaking drugs or treatment. Vet ahs diagnosed him as idiopathic headshaker.

He has severe kissing spines, one fused and two touching. Vet has says it is operable but no guarantee he will be rideable and does not think he will event.

He has arthritis in his neck and significant nuchal ligament desmitis at the insertion point (over the poll). He has been treated with shockwave for this but still exhibits pain in this area.

So with all that in mind, and the fact that I would not want this horse sold other than a companion and MAYBE MAYBE and its a big MAYBE he could hack very lightly then what is he worth?
 
He's not worth anything. I sold a mare with kissing spines in a situation similar to yours and she was only worth £500 I got for her as she's being used as a broodmare.

I would have said less, probably only £100 given all the problems. If you think about how cheaply you can get a horse at market to me that's all he'd be worth as a companion. I would say Dixie was able to get a little more as a broodmare but a gelding of that size is going to cost a fair amount to keep and probably won't even be a light hack.
 
Nope not litigation. I spoke to the dealer who offered me a good deal on another horse!! However, it did seem that I wouldn't get far down that route as she was 5 stage vetted and it wasn't picked up then.

I believe it only flared up because I started working her - a lesson learnt on buying horses who have been laid off a while.

I also was lucky in that she was the only horse I had ever insurance for LOU and the insurance comany paid up almost immediately. Was much easier just to sell her on - another piece of luck that she was a mare in that instance.

Yours seems very different though with the headshaking and other issues. Is yours not insured?
 
Mine is insured but not for LOU. He was a typical green youngster who was gobby when we tried him and we out the stiffness down to that. Vet should have spotted his problems I think.

Dealer is refusing to offer anyone despite having a warranty. He says he will then he won't then he says he doesn't own any of the horses on his website, then he has nothing (yet drives a top of the range 4x4). He knows the horse is knackered and won't get anything back for him and is going to be out of pocket and he doesn't like it.

Surely if he goes back to the dealer this wont do him any good? I know you need your money back etc.

Thistle - meat value is a very horrid way of putting it. No horse should be worth "meat value".
 
No I don't want him to go back to the dealer hence trying to fnd him a lovely home and the lady who wants him loves him like I do, so his long term future is very secure. I would prefer to loan him but she is too scared to do that in case she loses him to the dealer or I take him back one day.

And, I would NEVER sell him for meat!! But, know what you are saying re value.

He is worth nothing. Even as a companion his value is £0. He has a list of complaints. If i had been offered £500 for a horse like him i would snap their hand off (as long as they know the history).
You say the horse is in pain and also that it has severe headshaking (i.e. distress). If so i would very much doubt the horse is even suitable as a companion IMO. Please consider PTS if the horse cannot be helped to have a pain free retirement.
 
He is fine as a companion. Riding distresses him because he cannot perform, so as a companion he is fine and at this point he does not require any medication.
 
His value is meat money (approx £250). Therefore the offer iof £500 is generous.

Out of interest, was he vetted when you bought him? If so, will the dealer blame the vet?

What a nightmare for you.

Fromwhat you have said, I'm wondering if your case will actually be agai nst the vet rather than the dealer.

I've been in your shoes with a horse with behavoural problems. dealer said it was me , then I traced her history...... Fortunately got her a place at a rehab centre and she has had a happy ending.

I have to agree that the horse is only worth meat money however ghastly that sounds.

It probably sounds daft, but is it possible that the head shaking is connected to the spine/back/neck issues?
 
He has been checked and xrayed and vets say its not connected because he does it loose as well as ridden.

Yes dealer is blaming the vet although as we have said to him, if the vet had spotted it we would be ok, but he would still be in the same position with an unsellable horse.

A warranty at the end of the day is a warranty and he should honour it. I traced horses history in Ireland and it is highly suspicious he did it over there as well.
 
As far as im aware for anything to stand up in a court of law you need an Independant Expert & a written valuation from them which will mean employing them to value.

Values on here will not stand up in court im afraid. I would of thought your solicitor would of advised you on this.

I have just rehomed my gelding as companion he is young 8 yrs old he has ligament damage or soft tissue damage in coffin joint.I am hoping he will be sound in another year but have given him away as I have found perfect home for life even if he never comes 100% sound.If you are only talking of few hundred pounds wouldnt home be more important than price.

Did you have the horse vetted when you bought him? I'm assuming you did as it sounds like you paid very good money for him. So do you have some comeback against the vet as well as the dealer?

Sorry for the predicament you find yourself in and hope you get good legal advice and your money back. Good for you for finding an alternative home for life for the horse too and not just washing your hands of the whole matter.
 
sorry0im totally confused...was this horse not vetted??????? If so, why were none of these problems discovered and if meds dont work, howcome the headshaking has started now you have him\???? also if he was vetted then surely get the bloods tested?????????????????????????????? sorry, may have missed this info!
