New horse - owner cannot find passport!

Hello,

I am after some advice. I had a horse on loan from a friend for a year then bought him in January 2013. Since then the previous owner keeps saying that she is looking for his passport - I have seen his passport since he was transported over from Belgium so I know he definitely has one. I have a receipt to say I have purchased him but who is legally responsible to pay for a duplicate passport if she has lost it? It's been almost a year that she has been looking for it but is implying it is up to me to apply for a new one.

We currently have strangles on our yard and all need to be blood tested. To have the blood test a passport has to be present. Where do I stand? I have all correspondence saying she is looking for the passport etc... It's been almost a year now am getting quite annoyed!
 
I speak to her at least once a month and have spoken to her today. She has recently moved so hoping she comes across it when she unpacks! I don't know who he is registered with either. It's around £140 for a duplicate :/

It's around £140 and I don't know who is is registered with so am unsure where to go. I thought he was with AES but they have no record of him
 
She thought it was an AES passport. I've contacted them and his name is not in their database which is strange.
 
You can try the Belgium stud books or if he is a gelding and never going to be used for breeding can you not just passport him with a british passport issuing agency?
 
When horse passports were introduced in the UK I just got a cheap one from Farmkey for my Friesian. Even though she was fully registered with the FPS in Holland, it was so expensive to get their passport I just did a cheapy and was never a problem. Obviously if I had wanted to breed from her I would have gone the whole hog.
 
I was just thinking this. I have the vet coming in January so will ask her to scan him. His full name: DV Ron de la Villa D'este
 
Yes I saw that on an old forum post, but as it is a prefix to his registered name it is more likely to be the initials of a stud. Typically the breed would not be part of the name, for example you don't see dutch warmbloods with names prefixed with KWPN.

However, it is worth contating DV to see if they have a record of him:

Very interesting to find other horses with the same suffix. I've emailed the BWP to see if they know of him. Thank you so much for your help!

As you are aware that the horse has a passport you will have to make the previous owner provide it. I should consult your local trading standards officer as often a phone call from them will produce the passport. The Belgium passport issuer will have to issue the replacement document try the BWP 003216479980 and speak to Rudi Ederkins or the Belguim Sport Horse Society 003281330660 they will want to know date of birth,colour,sex,sire and dam and should be able to help. The person who sold you the horse is responsible to provide the passport and they should have to pay. The Vet will have advice from the BEVA on the proceedure for treating horses where the passport is not present and I think their new guidelines will require them to contact trading standards but I am not sure if this process is in place yet. Send me a contact for further help

Not sure that Trading Standards has jurisdiction over private sales?
 
Trading Standards are responsible to DEFRA for the enforcement of Horse Passport Legislation and the vendor has failed to comply with this legislation as they have sold a horse without a passport and Trading standards are required to take action. They also use other legislation under the sale of goods act which has more teeth.
It is irrelevent wether it is a private sale or not.
