You can't assess conformation from either of these pictures IMO-especially not the withers as the head and neck are down. Typical TB=high withers, but isn't always the case. Looks like a lack of topline and condition to me so maybe not as high withered when built up
 
I'd ask for a photo in daylight tbh.

Cheap horse but sounds like a whole can of worms.

Lieu of rent - is this formally resolved.
 
I'd agree with young farmer's comment, and ask for another picture. The advert suggests no real attention has been paid to him and he's lost condition..

Maybe go visit? Pictures are very good at hiding/highlighting areas that you can assess much more easily in person.

I agree with both the above comments.
Going by the description he can't have done much work for a while so probably muscle wastage/ poor condition despite the pot belly (thinking wormy belly!)
I'd be put of that the advert states no ligament/tendon damage, not a usual thing to put in an ad!
 
I would be very careful and check the ownership of the animal this is to cheap, ask for the last registered owner in his passport and call them. If all is correct he is a good buy.

Will be bringing up points mentioned and seeing if I can get a viewing when I get a free moment to respond to ad (still at work at the mo!).To be honest I am slightly put off by the 'situation' with this one so will try to find out as much as possible before committing.
