Other people's horses grazing my land!

15 horses belonging to someone else have appeared on my land! Does anyone know the legal position (in Scotland) on how best to get rid of them? I know where the owner lives but she shows very little interest in moving them herself! I've contacted a welfare association but they are not interested unless the horses are actually a welfare case, which they are not. Any suggestions?
 
Have you got any legal advice availiable, perhaps your a bhs member and I have a funny feeling that some insurance companies do it. What a complete nightmare for you.

Get a few friends together, catch them all, and turn them out in her garden. That''ll get her interested in moving them!
 
In England that would be classed as abandonment and after 14 days the horses become the property of the landowner. Post huge notices near her advisingr that said horses will be sold or removed on x date!
 
seek legal advice under Scottish law fast !! Good luck and I hope you can resolve it all quickly as a former welfare officer I know this can be a nightmare.

This, plus a recorded delivery letter to her address telling her the same. And even a notice in the local rag if necessary.

Bet they get moved then!
 
Oh how I'd love to know where this is and who it is! I think you could deal with all of this as a Small Claim in your local Sheriff Court OP. Post notice on gate and send her a letter (do you have her address/place of work?) telling her horses are unauthorised and you accept no liability plus you are charging her £15 a week per horse. When she doesn't pay, send her notices and letters to the effect that you are exercising your right of lien over the horses to compensate you for your losses. Then sell or take ownership of the best one/s, up to the value of the outstanding amount of unpaid livery.

I think you could also bring a claim for damages, on the basis that your land has been damaged by usage, eg poached fields, loss of grazing, etc.. Depends on how much hassle you want.

But if you want rid of them, simply hassle her on a daily basis. Or phone the police - its not your fault your fencing isn't in a good enough state to stop the horses escaping onto the public road, as you weren't planning on having horses in it at this time of year.

I'd also be concerned theres a welfare concern if she isn't supplementing the grass with hay at this time of year.

How could anyone, with any sort of conscience, consider knowingly endanger lives (human and equine) by doing that :confused:

OP you have my sympathy, a huge PITA for you, but as people have said, you must be seen to do things legally, otherwise, perversely, the whole situation could turn around and bite you on the bum.

Update! There's good news and bad news. The good news is the ponies are no longer on my land. The bad news is that they left my land (no idea how) and decided to go and play a round of golf or two! Seriously, the ponies were found running riot over the local golf course! Can you even begin to imagine the damage?! After several hours and an apparent failed attempt by owner to catch them they are now happily grazing another farmer's field. So selfishly no longer my problem. Will keep you updated as I doubt this is the end.
 
Crikey she sounds a nightmare. I bet it will sort when the golf course come after her for damages! I bet they have a few solicitors etc as members....!!

Recently read an article - think it was H&H about a company that you can call to remove horses from your field. Believe they turn up in the dead of night and was aimed at gypsies.
 
The subject of solicitors could be an interesting one. This woman rents ground to graze her horses. Apparently the man who owns this ground has the same solicitor as the one used by the golf course! It's always the solicitors who win! He gets money both ways!
