People baffle me.

So I run a Yard and all of my liveries are on part livery which they are done mon-fri owners do there horses themselves on the weekend.
One particular owner I have now asked to leave due to the fact that she 'forgot' to do her horse on the weekend leaving him in with no hay or water and in his unmucked stable. I had the dreadful noro virus over the weekend and all I had was calls off of liveries Asking whether they can give him hay or water and quite obviously upset, obviously I was in bed dying so I couldn't do my usual checks on the yard in the end I dragged myself out of bed to turn the poor sod out. Lovely horse just owners do not care. Sent her a letter asking her to leave (she didn't pay full livery price last month and I have constantly asked her for this money with no acknowledgment) and she rang me up saying that she was moving on the 11th to be with her boyfriends horse which is perfect. But said boyfriend came and collected all of his rugs feeds the lot leaving my groom nothing to care for him. Just a rant really but being a Yard owner really is mentally draining sometimes and it is hard not to get upset/angry ;-(
 
I couldn't do It. No amount of money would be worth having to deal with people like that. I hope the poor horse doesn't suffer too much in the meantime.

Perhaps it would be worth adding to the contract that if horses aren't cared for properly on DIY days you reserve the right to feed/muck out as necessary and charge the owner the weekend rate (which would be a lot more than they pay for week day).
 
What a witch (the owner, not you OP).

We looked at having a livery yard. I decided it just wasn't worth the emotional stress. I'm obviously very glad there are people who can cope with irriates, so thank you all you good and steady YO/YM.
 
I have thought of this but my partner politely pointed out that if she hasn't paid full bill from last month then she won't pay for any extras ;-(
 
Apart from you being ill, and i hope you are feeling better why didnt you make a phone call to the owner asking where the hell they were rather than other liveries phoning you about it? I know you shouldnt 'have' to but surely a quick phone call asking if they are still alive and that the horse hadnt been seen to would have sorted it out?

Apart from the poor horse i agree you will be better off without this livery but i would have locked there stuff up (and horse) until i had seen payment in full!

What an awful situation to be left in, I think I would be tempted to ask her to attend the yard to pay any outstanding money and bring enough rugs and feed to last the 8 days remaining, no at this stage I would tell her you will meet her at the yard at x time, hand her a bill, put the rugs/feed she should bring with her in an easy to collect place and remain calm (Says I who would be spitting nails). If you know where she lives and no feed or rugs are brought for her horse I would be tempted to turn up and collect it, if no-one is home just leave and take a photo of sign left on her door (You have left your horse with me with no feed or rugs, please rectify this situation today, I will not tolerate cold or hungry horses on my property, thank you!)

There's always the small claims court. It probably wouldn't get to that, the threat of it is often enough. There are plenty of template letters on the net and a solicitors letter isn't vastly expensive. There are also no win no fee debt collection companies.

Well actually you could do what Antw is saying - I don't think I could give this horse back (obvs you'd have to eventually unless it was settled in/out of court)!! I'd keep it as "payment" until either I got the money... hard on you as well because the horse is "kept" at your yard so you also have DOC etc... so frustrating and horrible situation. At least you are taking some steps to safeguard the horse... good on you.

Please don't do the above, it is illegal to hold on to peoples property in that manner. We have small claims courts for such eventualitys, unless the contract states that the horse or equipment will be held in lieu of any debt. Strongly worded letter about feed and rugs until the horse moves, or feed it yourself and add the charge to the final bill, which you may then have to pursue through the small claims court.
 
You can't go keeping people property because you are in dispute with them .
OP Just get the next few days over with and get rid .
Poor horse but there's nothing you can do .
 
Agree - poor horse, I would find out where this persons 'boyfriend' keeps his horse - and then if possible phone up that YO and pre-warn. At least this way the horse's welfare has been raised as a 'red flag' to the next yard.

I don't get people like this.. why do they even bother having a horse / animals, if they cant be bothered to care for them.

If I was the 'boyfriend ' I would be running for the hills !!!!!!

Its a good job you dont own a livery yard!
Its illegal and you may end up in the cells and you could end up paying out more than they owe you. Personally if their leaving on the 11th anyhow I would boot them off today whatever you do you are very unlikely to see the money anyhow so get rid quick and cut your loses . Nobody would blame you for that!
Just to say if they whinge that they cannot leave today that is your opportunity to rectify the financial arrangement and demand payment up to to the 11th in lieu of you backing down or just be strong and tell them to go. There is no room for sentiment being a yard owner its your livelihood!

Maybe but not until the horse has left the OPs for obvious reasons!
 
When in these situations I'd much prefer to get rid of ASAP without the Agro I found out a couple of weeks ago that she owed previous yard £700 😞
 
And boyfriend has already done a moonlight flight with his horse a month ago after him and said woman had an argument as he was worried she would steal his horse as passport is in her name (he had purchased horse and has receipt of proof) Bringing there personal issues onto the yard etc. But obviously now together! Woman sold her pug as she didn't have time (dog didn't leave the house and forgot to tell buyers it had epilepsy!!) and needed the money and a week later brought a puppy Akita, this just shows what said woman is like!

Are you hard enough to kick her off today? Its your only hope of seeing something back or at the very least cutting your loses <I think you know that!

Do you not think that was part of a bigger plan maybe. Sorry but I get cynical as I get older sad but its what liveries did to me.
 
I would tell her that as a result of non payment she has 24hours to remove the horse and all belongings from the yard to include X outstanding monies due unless she pays until the 11th in advance.

Summarise that you wish this matter to be resolved amicably before legal advice is saught and non payment will result in further action being taken.

The threat of it being taken further may spur her into action.
 
We had one DIY on my old yard who shut her horse up on Thursday night and then went to London for the weekend with a man other than her husband, without making any arrangements for the horse. Luckily others noticed and made sure the horse at least had food and water. On my other yard a chap put a thick turnout on his horse in July and went away for the weekend, again without telling anyone. We took the rug off as the temperature was in the high 70s. It goes on more than you think I'm afraid.
 
Out of sight out of mind for some owners it seems. They think about their horses when they are on the yard but then forget they are horse owners once they are off site.
