Please help, anyone successfully sued a dealer?

As I'm sure you can understand I can't go into details on the internet but my friend needs to sue a dealer for selling her a terminally ill horse. The legal advice we've had from the BHS is that she can take him to court but he's saying even if we take him to court he won't pay up.

Has anyone been successful or can recommend a lawyer?

Small claims? would that be better? I "think" (do check!) that if he defaulted you could then go down the route of a CCJ?

A friend was sucessful in getting her money back but it was from sheer persistence and took a long time...

I would speak to Jacqui Fulton who is an excellent equine lawyer, She represents various different cases.

I think it it is Fulton Equine Law. Small claims would be your best bet. But Jacqui can advise you whether she feels you have a case.

There is no problem taking him to court. Use a good specialist Equine Solicitor. He may well not wish to pay up but once there has been a judgment made against him this will be recorded and he will find it difficult to obtain credit in the future and anyone searching his name will be able to find that he has had a judgment made against him.
