Prices for Travelling horses to Lessons?!

A livery yard owner occasionally takes clients and their horses to shows, along with her own, in return for sharing fuel costs. What must they do to comply?


VOSA: "As it is not in connection with a business, this is a private arrangement and, as long as no payment for transportation from A to B is involved, no OL or tachograph is needed."


Defra: "The regulations will not apply if the journey is purely a private, non-economic activity with friends sharing fuel costs, irrespective of whether they may also be clients, provided the transport is carried out separately from the livery yard business."

NO!!! See the bits in bold and underlined! You are paying your friend to transport your horse, not sharing costs, therefore the operators licence will be needed, at the very least a competency certificate :)
 
OK, it seems as always the rules are not entirely clear and, as always, rules have been put in place to screw money out of people.

So, if the friend takes the horse, just RR's horse, to the show and gets no money, we're all in agreement that it's fine. If the friend takes her horse petrol costs are shared, we've concluded that it's fine. If the friend takes only RR's horse and get petrol money, this is where it becomes illegal? Or is it when they get something in return, be it money, chores done, whatever?

TBH, I fail to see, unless the people involved say anything, how it could be proven that somebody was getting reward for transporting a horse. Correct me if I'm wrong, but say the reward was not monetary but was mucking out/general horse chores/a bottle of wine, how could that be proven? Genuine question, not trying to be ars*y, I just I can't see how it could be suspected and/or proved unless RR or the friend told police/insurers that was the case and surely if suspected, it would be very hard to prove, in particular if it was jobs being done in place of money?
 
Pop out with your friend for some fish and chips the night before, put the diesel in then! No operators licence required for a trip to the chippy. How kind of her to take you and your horse out of the goodness of her heart.
