RANT WARNING/HELP?Farrier you just reversed into MY truck:-(

OK...so its monday...and what a monday it is!

I'll try keep this less epic than usual...

farrier came to do horses today...reversed into my yard...asked him to reverse up & park behind my truck....I'm sure I didn't say IN my truck...ON my truck or UNDER my truck but I do recall hollering STOOOOOOOOOOOOOP at least three times. I was in full view of both backs of both his & my truck...and in full direct view of him. I started with my hands a foot appart decreasing as he reversed while he was 2.5 feet away & clearly shouted stop & held my hand up clearly with about 1.5foot to go.(allowing for male driver & the 6inch rule...girls you KNOW what I mean!) He just carried on driving back until he crunched into the back of my Warrior. He got out asking oh is it really nasty...to which I & my TWO WITNESSES stood open mouthed & said yes, not awful nasty, but still nasty. he made a comment about the state of his incredibly battered l200 and said I don't care, look at mine!and laughed. I actually thought he would apologise or do the normal & be honest & pay up or at least mention finding out damage cost-it will be at least 250 prob more as he has broken the paint and dented my beautiful truck-muddy ..yes plastered..but immaculate underneath...oh and bare in mind we've just had snow & ice so not likely to have washed it am i(have less suicidal tendancies than you may think!particularly outside where my horses have to walk in & out up a step into their barn.

We carried on & he looked at the mare, pared out the sore bit(20seconds work) looked at the other horse he was there to trim but decided not to trim(after vet debacle other day horse is now very stressed with men but was not contemplating climbing walls as I had given him sedalin (purely due to vet scaring him so to have a good experience with no sainsburys style toddler tantrums)...anyway he then did not have time to put fronts on my other mare with a huge new split in her hoof(a week after trimming) so he walked to my truck, penned me in for front shoes & sedated trim next wed and was glaring at the back of my truck subtly but visibly so i took the oportunity to ask him how much I owed him...ie you have damaged my truck...how much do you owe me...so he said £20 and held hand out to take it....mugging idiot that i am, I was too gobsmacked at still no apology or offer to rectify and flipping paid him and then he just drove off.

Shils if you are reading this..please can you breath flames on him.

I really do not know what or how to go about getting it done. Obviously I have two witnesses & there are more farriers...but..very tricky as I hate confrontation...I could ask him next wed & say look, checked the damage & washed truck off also found you have damaged the immaculate pristine chrome bumpers and its going to cost X...pay him for doing horses & give him the opportunity to pay me or give insurance details...if he won't i will happily go to the police as he will technically have refused still...am I too late?he did admit it in saying is it bad...but lets not forget I was stationary on my parked legs and had tried to stop him and there is NO way it can have been my fault...

What do I do????:( Poor Truck :(:(:(
 
Er, why didn't you get his insurance details? It's not about 'giving him the opportunity', you need to ask! Phone him now and ask who he is insured with and just say, 'I'm sorry, I forgot to ask you for your insurance, earlier'. :)
 
I know...i was just a bit stunned & stood there catching flies as he drove off while i stood holding my mare pathetically...tho thats a really bad thing for him as he will be in serious trouble with police I would have thought if refuses to pay/recompense me....both witnesses were clearly stood in full view & my groom was trying to stop him too..builder nearly choked on his sandwich 3meters away...its only small damage but it is still damage:-(

Go and get a written quote and ask him to pay it, not sure about police as it was not on a public road.
 
I did this my first week on my current yard, was in a world of my own one early morning reversed round and crunched straight in to the side of a fellow horse owners car.

My bumper popped out so no damage to mine, but his rear door was caved in. Straight away I offered my insurance details and so many sorry's. He just said he would get a quote for the part and I'd give him cash.

I believe he is still driving round with a dented door but hey I paid what he asked..

Call your farrier now! :D

first thing in morning...going to go to three garages so he can choose..think I'm being very fair!

You are a good honest person tho & have a clear conscience & good karma will be chasing you!...as for my farrier? he's not answering so I will be chasing him!;-(

I just felt very guilty, I was so upset that I had damaged his car.. Didnt even think twice about offering him something. Let alone the fact I would be seeing him every now and then up the yard couldn't have avoided him forever didn't want to start off on the wrong foot I was the newbie as it was. :D

Best of luck getting it sorted, always a small claims court if you wanted to take it that far..

Thank you...you know..that wouldn't actually be that bad an idea...pathetic i can hear some of you cry?I don't know...its a principle thing..I might have felt differently if he had atleast made the effort or offered or even looked sorry...I had to eat a whole box of french fancies you know...AND buy two scratch cards!Both useless!;-(
 
no answer to my text or call...so have decided to report incident while I'm still within the 24hours to the police...on advice from very helpful bobby....should it turn more pleasant I can drop it & no further issue...if i don't, I'll be decreasing my chances...now just hoping he's not vindictive..might be posting for a new farrier later! Hate situations & confrontations:-( hope its a better day today:confused:
 
We had a discussion at work the other day about 'guiding a reversing vehicle' and that they were considering having someone 'trained' becuase as soon as anyone 'guides' a reversing vehicle backwards the are 'responsible' and they were discussing that our workers cannot 'guide' a vehicle back anymore and if a lorry driver asked to be 'guided' they had to say 'i will assist in guiding you backwards but i am not responsible!' or something silly like that! (it made me laugh which is why i remember it!) i'll ask the transport chap to send me a link to this 'rule'.

However i dont think many people would be aware of this rule but if it did go to court i dont know where you'd stand! even though you clearly said stop!!! x

Men drivers - clearly the worse :D x
 
Why not just call your insurance company report that someone has backed into your parked truck and give them the details of the person who did it. They will sort out repairs to your truck and recover the money from his insurers. You have your farriers full name and address I presume (if not check out the worshipful company of farriers website). They will write to him to get his insurance details.

Not quite sure why you are planning to report it to the police as he hasn't broken any law. He hasn't refused to exchange details as you didn't ask him for them and allowed him to just laugh it off.

I appreciate you don't want to ruin the relationship with him so let the insurance do it all for you. If he mentions it, just say that the damage was worse than first appeared so you had to claim for it on your insurance and had left it to them to deal with.
 
I can understand why you were too gobsmacked to do anything about it but he has damaged your car and he must fix it. No need to feed worried about asking him. My feed delivery lorry backed over my friend's Range Rover :eek: :o and did loads of damage, they paid up no problem. My friend being 6ft 2ins and built like a brick outhouse probably helped. Don't let him put one over on you just because you are a girl :)
 
A recordable RTC for Police purposes has to be on a road. "Owing to the presence of a vehicle on a road...."
It would therefore seem to not be a Police matter, unless there are criminal aspects such as criminal damage but that doesn't appear to be the case. Did you get the registration number of the vehicle to pass on to your insurance company?

Not sure the police need to be involved to be honest. Call your insurance company with his insurance details, if not then at least his reg number and let them sort it out, that's what we pay insurance for.
 
Certainly not a police matter.Unfortunately since you were directing him,it will be your fault.Unfortunate but true. Contact your insurers and let them handle it.
 
Definatly not a police matter.
The haylage lorry hit my parents parked car during a delivery they paid my Dads bill the farrier should pay yours they did not go through there insurance.
I would ring the farrier and ask do you want to pay me or claim I 'll get three quotes.

Yes of course they do. I was sitting in my office in the autumn and watched open mouthed as one of our fishing guests reversed his van straight into my groom's car, seriously damaging the front wing and door frame. :( Although doing very little damage to his van. I saw him having a word with OH, but he made no attempt to go and find the owner and tell her what had happened, just got in his van and drove off :rolleyes: I sent her off to get a repair quote and when he came back, told him how much it would be and he went absolutely spare, and ranted on saying "the car wasn't there when I drove in, and I was watching out for dogs and children the other way" - er, the car WAS there when he drove in, and what if my dogs and kids had been where the car was??:confused:

Fortunately, the van was RoI registered and they have to carry the insurance details on a tax disc type thing, so I took his details, and groom's insurance company sorted it direct.
 
The exact same thing happened to me on our yard (well it wasn't the farrier). It's not a police matter and you don't need to go through the small claims court, your insurance will sort it out and yes they do have to pay up even if it's on private land. Give him the option of either getting quotes and him paying you privately for the damage or getting insurance involved. If he doesn't get back to you in 24 hours report to your insurance company, give them his name, his address if you know it (and it should be on the farriers website) and the type of vehicle he has (assuming you don't have his reg) and they will be able to trace him.

If he is a good farrier though I'd be nice and give him the options first!

It will not be her fault because she was directing him. It may be considered that she was partly at fault though and it is possible that insurers might agree to go "knock for knock" or to "drop hands".

You can't simply ask someone to watch you out and then be absolved of any responsibility. The same goes if someone flashes you out at a junction or if you pull out in reliance upon a green traffic light. You still have a duty to make sure it is safe.

Further the OP says she had told him to stop but he didn't heed her warning.

Thank you Kat...I did check my cctv this am...and it clearly shows him crashing and me and groom both frantically shouting stop even after he made contact with my truck he actually shunted it further...I didn't realise at the time but he actually did stop fractionally & then reversed again...careless or whatever he still has not responded...I spoke to the police & they confirmed that then WOULD make it their concern without a doubt as he is withholding details. all more headache than i need but at least it means i can't be causing mayhem anywhere else if confined to dealing with this kind of rubbish:-( thank god for the cctv hey
 
His number plate was so caked in mud-front & back it was not readable as clearly shows on my cctv. I am not attached to him as a farrier & there are plenty of good ones around so not worried if keep him or not..plus won't be staying in this area - as soon as house sells I'm off! I'm still trying to get hold of him as my excess is prob more than the damage..(£450excess) so as I said earlier I wanted to give him the chance to pay but as yet he is still not answering or reply to calls or texts...he is always v quick to respond-this is why I would take things further..I've not been ar*ey or at all unfair & paid him in cash for his time before he left so absolutely totally no an acceptable way of handling things..tho I'm reading thru this & kind of feeling like i'm the bad one.I could not see a tax disc on his truck on cctv either anywhere on front screen..that says an awful lot.just mega fed up and to top it all all 4 of my horses are now not right in some way or other...just home from breakfast! rubbish week and 2nd accident this year...one on jan 2nd in carpark...again i was not in car at the time...hoping this isnt forming a nasty pattern....could just do with a bit of good luck
