Re my package that i sent with Royal mail special delivery insured , in Feb , where 1 of the 3 mobile phones did not arrive , was lost in post or whatever has happened to it !!!!

Sent strongly worded letter to them last week , received letter today saying they are satisfied that they are within their rights blah blah blah , I havent provided sufficient evidence to support my claim !!! They are not compensating me for the lost mobile!!!!

I have emailed trading standards etc to see if anyone can help ,, any advice anyone ?????

ehhh No , I gave them my proof of posting , as that is what they said they needed to check and compensate me !!!!

grrrrrrr , i dnt thnk i can find my copy of the original !!!
 
As an ex RM employee, special delivery is insured for upto £2500 unless you tell them if it is worth more than that. Was the packet damaged and missing the phone when the recipient signed for it? If it was then they should have refused the package. You do need to keep a copy of the special delivery receipt for any claims.
 
The contract with RM and you is to deliver the package. I've read your previous post and it's evident Envirofone signed for the package without stating it had been opened/damaged/tampered with, thus, as far as RM are concerned the goods have been delivered, and the recipient has received them - and who is to say he/she hasn't as the parcel has been signed for by Envirofone. Hence RM's reply to you. In actual fact Envirofone are in the wrong here as they are passing the buck by telling you to complain to RM as they have signed for and admitted receipt of the parcel. If the parcel had been opened or tampered with then they shouldn't have signed for it, and if the package was found to have been opened, goods removed and resealed prior to delivery, then the packaging should have been retained by the recipient and it's a matter for the police. Unfortuntely as such time has elapsed it may now be difficult to take this tack with Envirophone. I think the only way you can 'prove' this to Envirophone would be on the basis of what the package weighed or even the size of it - you couldn't fit 3 phones in the smallest jiffy bag for example -when you sent it if you know that then I think you could prove to Envirophone that a) it weighed enough when you sent it for there to be 3 phones therefore there were 3 phones when RM received it b) that they signed for it c) that they didn't query the contents at the time of opening your parcel and you could write a letter to that effect to them demanding the extra money. Even so I think you should send a strongly worded letter stating you have sent this to them via RM SD and they have signed for the package. I presume you included a letter or form in the parcel to say what you were sending as well as your details - in which case if there was a shortage I think they would or should have queried this with you on opening your parcel and before sending the cheque, so you could include a copy of this letter or form in with your complaint letter to back up your complaint, along with the POD signature proving they received it (from the RM website)

However you may be on a sticky wicket to prove what you sent (I can see this might be Envirofones argument) , as modern mobiles tend to weigh about 100g or less, and as you paid £5.05 for the postage (in the 100-500g bracket for Special Delivery so that could have been for 2 or for 3 phones UNLESS the other 2 were VERY small and light!)
