we received a letter by post saying that the breeder who had my shetland has sold him?!!! as she had not recieved the full payment for him and thought we didn't want him anymore!!!!

now heres the story in full: we found little tambo and instantly wanted him, sent our deposit and were told he was secured as ours for 2 months ( so he should be kept as our until the end of october early november) we went to send the rest of the money but the bank couldn't wire it through so mum had to wait for a cheque book coming, the bank took ages to send cheque book, finally got it then mum sent cheque straight away and what happens?? POSTAL STRIKE!!!

now see heres where i am confused, we had been promised that he would be secured as ours for 2 full months we were incontact with her telling her the problems all the time, and that her cheque would be there asap. mum had been trying to phone this woman to see if she had recieved the cheque loads and had no luck.

i think its very rude we were so excited about gettin tambo even had headcollars and leadropes for him ready for his arrival, and now out of the blue he has been sold (gutted)

sorry bout the rant i may be in the wrong but i'm still upset

I can understand where you are coming from as I was meant to be getting a couple of new horses this week but the seller has now changed her mind and decided not to sell after all.Ok I'm upset but I can handle it.My son who has special needs that one of them was for can not and is devastated.
 
it wasn't in writing, other than via email conformation. i still think she could of at least warned us or something, he was suppose to be secure untill early november. so now having someone interested in poppy, if she goes i hav the problem of trying to find another horse as a friend for becky
 
when buying and selling horses i never believe a word anyone sayes,only deal in cash,(no deposits and/or pay later),and sometimes spit on my hand.(

Has she offered you your deposit back? The emails could be used as 'evidence' so i'd be asking for my deposit back in full and searching elsewhere. I presume now you have the cash?

yeh i've been soooo excited, i've always wanted a wee shetland, we were planning on using him for showing and driving once he was older

see we were so ready had everything planned for him. really wish we had just gone up north an put the cash in her hand. it was her who told us this was how the payments for her ponies worked too
 
we are gettin the deposit back, and she had also received the cheque and is sending that back too?!! but we aren't so fussed bout the money its more the whole principal, that we were really excited to be getting him
 
She has made a contract with you, & if you have the email where she has agreed to wait then she does not have a leg to stand on. Problem is do you want the expense of a court case?
 
oh no no, its her loss, her pony would of had a great home here and would of been the happiest wee chappy alive. she will be receiving a strongly worded letter however!
 
How awful.

Have you called the breeder to discuss this? If she had said that the horse was secured until the end of October, then why has she sold him? Email confirmation of the agreement should be enough to get your deposit back.

I know that it is not the same, but would you be able to go back to the breeder and buy another one now as you have the money to hand?

I know she had some ponies at the horse sale in Aberdeen a few Mondays ago and heard that she is wants to everything she is selling to be gone before winter sets in.

although it is sad for you, i personally would have done the same and sold to another buyer.

had a similar scenario..almost identical infact..sorry awaiting new chq book/postal strike etc etc..

was quickly resolved when i said if i didnt receive a postal order by recorded delivery next day the pony would be sold on...

and guess what...they drove over and gave me the cash that evening!!!
