if a horse is sold by a dealer and on the receipt he writes "sold on behalf of ......" then the horse develops bad vices and is nothing like the horse you tried do you think the dealer can wash there hands and say its between you and the person they were selling on behalf.
 
that is what the dealer has just said to me but surely they were taking the selling livery from the owner showing the horse to us so they must have some legal responsibilty or all dealers would say selling on behalf of a client
 
A friend of mine had this happen. She took the dealer to court and won eventually but only due to a "witness" making a mistake. The dealer, a well known rider at the time, took a huge amount of commission and my friend had to take the dealer and seller to court. Cost about £40,000 to do! Dont know if they ever got the money back even though they were awarded costs, as everything disappeared, including the horse!

To be fair I think the owner of the horse was totally innocent and did offer a complete refund but it was significantly less than she had paid the middleman.

Sorry, that is probably not what you wanted to hear but hopefully it gives a warning to others.

I think it is really important to establish from whom you are buying a horse.
 
it does seem like there is a loophole in the system there. so not only do dealers not have to buy in any stock (selling Livery) when the owner does not tell all vices etc they sell it on and get commission you pay them the money and how do i know what they tell the owner i paid. then when it goes T...s up it is nothing to do with the dealer you are then having to speak to the owner. it seems totally fair the system. perhaps the owner should sign a CV with vices / good things on like they do at the auctions in ireland
