hi there
i was wondering if i could get some opinions off of you all!

i have a friend who bought a horse (receipt says doesn't nap and doesn't blow hot and cold when competing)- and it does! was bought about 12/ 14 weeks ago and obviously it has taken this long to establish what it does!! can she take it back as its exactly what they said it wasn't??? even if its just for an exchange for something else on the yard (although technically they're not dealers).....

There was something about this in H & H recently see if you can find it. About buying and your rights. Did they offer and exchange period etc?? Approach them they can only say no?
 
they never said anything about an exchange as they assured her it wouldn't behave as it has (in writing too)- dont know about bhs membership - ill ask....
 
You have it i writing which is good. Im guessing this could be a messy situation so you may be aswell to get advices as suggested from CAB or someone similar.

I hope she sorts it out, Very annoying for her
 
I would imagine, no disrespect that she has made it like this, it is very difficult to define how a horse is going to react to someone new, i bet if you put one of there riders on it it would be as good as gold... i sold a bombproof mare, really safe which i home bred to someone a few years ago and after about 6 weeks she started to play up, she was 14yo at this stage and had never played up before, i got on her and she was perfect, sorry but sounds like rider in this case. Horses are not machines.
 
Indeed, i had a little NF pony who was an angel, completely bombproof, when he went to his new home he reared up all the time, literally daily when out. The woman approached me, and i said i would have him back (im a bit sentimental!) but the old bag moved away and sold him. I located him and he was sold on without me knowing to some riding school. OUCH!
 
It's a difficult one in view of the time scale. 12-14 weeks is plenty long enough to ruin a good horse (not saying that is the case here

). Most dealers offer 1 or 2 months warranty / exchange period at most as that is usually long enough to identify any 'issues'. I would say after 3 months you'd be struggling to prove that horse had these problems when it was bought, unless you can find someone who knew the horse previoulsy. That said if it was a totaly genuine horse they may take it back so that they can place it in a more suitable home...
 
if she bought from a private seller, then no, she will not have any comeback from the seller. if she bought from a dealer, then she may possibly have something, but worth speaking to CAS/lawyers first. Most people (if they are sensible) sell with a receipt "bought as seen" then you have no comeback.
 
she did well to get it in writing that it didnt do those specific things, but 12- 14wks is a long time, long enuf for the pony to know what it can get away with, also as mentioned most recipts have a time period of return, set at 28 days. i think she will be unlikely to get her money back! yard though may take her back at reduced price, to account for re-schooling/advertising!

sorry if this sounds a bit harsh but iv also had recal with horses sold, after selling honestly, its simply that they are testing out their new jockeys, they all do it, your friend should just get some lessons and work through it, once the pony knows shes boss things should settle down.
 
i can promise you its not my friends riding - shes a fantastic rider - represented GB show jumping etc... and in the last couple of weeks people have started coming out of the woodwork saying things like "ooh yes its always done that" and "well as long as you can accept that sometimes it jumps and sometimes it doesn't" etc etc... very frustrating for her im sure~
