Registered keeper on the passport?

Hi!
Does the seller have to be the registered passport keeper? Is it illegal if they are not?
I have always wondered this, I thought you had to be but I have been also told otherwise and that there is a new rule?

If you've bought from someone who isn't in the passport, then the PIA will contact the last registered owner and check that they sold the horse before transferring to you :)
 
The PIA dont allways check, and it's not illegal, however I would be looking for further proof of ownership. When I bought my mare the current owner hadnt changed the details from the breeder but she had the bill of sale. I then had to send my bill of sale to the PIA to get the owners name changed to mine, and they didnt check with the previous owner.
 
Some passport people take aaaages to do the transfers (breed societies run by a few part time people), my new horse is still in the name of the owner before last and the last owner's transfer is pending apparently, so I have to send off mine and who knows how long it'll take :-)

I don't think I've ever seen a passport with the right name on it actually!
