Removing a livery.

Sounds like booking the poor thing into the sales and let the owner know what you're doing, if she removed the horse - great, if not go through with the sale sadly in the knowledge of where the poor thing will end up - but if owner doesn't care and can't afford her then worst things could happen.
 
Hi this is not good.If it was me I would tell the owna that you are going to involve the police and would horse welfare if the horse is not gone by Wednesday see what she comes back with.good luck

sarah, what response do you think the Op'\s friend might get if she rocks up at her local high st police station and says :

'excuse me officer, but ive got a horse on my land that wont leave, will you come and arrest it, and and you might need some extra large handcuffs and please bring one for each leg?'

If my rather rusty law degree serves for right- and it might not- this is not a criminal matter.
 
AM. While I agree with the police aspect. Would whw be interested due to YO saying that the horse is not fed unless she does it? Of course I know this gets tricky as she has a duty of care on her land though.
 
We had a horse that was suffering because its owner has lost interest and didn't come for weeks on end, so I traced the horse's former owners and told them that it had fallen on hard times.
Between us, we managed to get the current owner to give up the animal and let it return to its previous home.

Don't suppose, your livery would give up the horse if someone would take it on otherwise, if she has lost interest, its future doesn't look very rosy.
 
Having a contract doesn't prevent this situation btw. You can have as tight a contract as you like but if someone refuses/fails to pay
(and then you give them notice,obviously) and then they refuse to leave,a contract doesn't *do* anything. I gave someone notice to leave (as horse was dangerous (to humans and equines) and owner was in denial despite help from various quarters (and,frankly,a bit mad...))
and she just wouldn't go. She didn't even look for alternative livery! When I asked her (10 days into a 14day notice) if she'd found somewhere (we were still on speaking terms,she had just gone completely quiet on me-to be expected in the circumstances,I thought) she just looked blankly at me and said 'No. Why would I have found somewhere else? We're happy here. We're not leaving.' After my initial stunned couple of seconds I reminded her of the verbal AND written notice I'd given her and that she had no choice. She still maintained a 'La la la,can't hear you,fingers-in-my-ears' kind of response,to which I demanded her key back (she said she didn't have it on her...a lie) so I removed all her tack & gear from the tack room and informed her she had the remainder of the notice to find somewhere,take her horse and upon that & return of my key,she'd get her tack&stuff back. I said if she hadn't taken the horse,it'd be tied to the gate at the end of the last notice day (tho I couldn't have done this...and was hoping it wouldn't come to it!) She did adhere to this & removed the horse on the last notice day but I found out later that she hadn't looked for anything up to that point and thought she'd just 'brazen it out' at the yard. Eh??!? Some people are just weird or a bit mad. She owed me livery for the notice period but I didn't pursue it-was just glad to see back of her&the horse.... Good luck to YO in this case-feel for you!

I have had a text from her today saying she should be getting confirmation today of when she can move to new place! Will wait and see but sounds quite positive:D

It could have squatters rights or be done for tresspass ??? lol - sorry thought i would lighten the mood

Well the law regarding squatters has now changed so perhaps it could be arrested for that? :D

OP & YO - if she says it will take X amount of time until she can move the horse, ask for confirmation from the new place that this is the case [not "normal" I know but you need to cover yourself] and ask for the money upfront for the remaining amount of time. If she doesn't bother, perhaps look into [if possible in this situ] taking possession of the horse as lien.

Whilst I agree with the contract, I'd be wary of the references. I would have got a dreadful reference from my last YO despite going up twice a day, ensuring the place was left spotless, looking after my horse 100% because I objected to him allowing a very unpleasant character near the children at the yard. Three or four of us were thrown off for having the guts to complain about it. Anyone can make up any nonsense they like about an ex livery.

If I were a YO, I'd be taking a hefty deposit for such a case in future.
 
I would be cautious about contacting the new yard as suggested above....if they get wind she's a bad'un they might change their mind about taking her and you might end up stuck with her horse even linger😳

HI, im in this situation at the moment, i have to move my horses by sunday and at present i have nowhere to take them, i have an arrangement for the end of april however YO wont reply to texts let alone talk
The knives are out as well someone, and i dont know who has spread rumours that one of my horses is a welfare case. I would like to point out that i take very good care of my horses
which is obvious in that i won the best condition trophy at our local riding club for last year
The reason im being kicked off is because i complained im sure the YO will have some really horrible stories to tell , all i can say im my defence is my complaints were completely genuine
at present this is not the time or the place to disclose these as they ARE REALLY REALLY BAD
When i finally leave this yard it will be no loss
 
Wow hang fire everyone, are we humans so bad, no wonder animals are being mistreated by us when we cant even be decent to fellow man. It is not always easy to just find another livery yard, and if you are short of money it is also harder to do that, and because she doesnt visit the horse everyday whilst it is turned away (a good thing for an ex racer) doesnt mean she doesnt care about it. There are always two sides to the story re feed etc. Sometimes it just takes a bit of sitting down and talking it out the YO's concerns about the horses welfare and arrears in rent, not texting and emails. You get more with honey than you do with vinegar, sweet words make people listen not harsh ones.

Horse lovers and yet we care not that we will evict an innocent animal and tie it up with baler twine (that doesnt break so it could break its neck if it got a fright and tried to get away and lost its footing) to a gate post.

I hope it gets sorted now she has found a yard but dont go and put your penny farthings works in and alert the new yard that she owes you money.

Totally agree! It's so nice to see a view on here which is not negative and nasty like the majority.
 
Well, here's my story. I also had a problem with a livery that would not go, was a friend so had no contract. Her horse was 27 and CRIPPLED, fetlocks were touching the floor! had major back issues, was emaciated when I took it in for her (she saved it) and yet rode it on a regular basis (atleast 3 times a week hacking, cantering up hills) and she was not the lightest of people.

The only thing she was interested in was riding it and telling everyone she had a horse. Didn't bother to worm it or vaccinate it though, I had to do this and never got paid for it. I looked after it morning and night for 6 months for not a penny, and actually spent money on feeding it, all winter.

The last straw was last summer when I asked her for the first time ever to do something. Fill the waterer in the Field. Cue, enormous break down, how the horse had a dirty stable etc. Forgot the fact I looked after its every whim for not a penny or a thankyou for months and I spent hours looking after it despite doing 43 Hour weeks.

As I took her in for company for my horse, and she wanted me to take it on so she could have a horse I took it on for her, as a favor and it did help me out too as meant I didn't have to buy a companion for my boy. She told me she was moving far away (and she actually did) and was taking the horse away before the end of the month (3 weeks). I got someone else in very quickly as my boy cannot live alone, which meant I no longer had room for 3 when the new livery arrived.

This ex friend went totally mental and her OH, F'ing and blinding saying the horse wasn't going anywhere and that she never said she was planning on taking him away (yeah right ! didn't bother her at all when telling me I had under 3 weeks to find another companion!). I fixed a date by which she should be gone. The day came, horse still there. By this time she had showed up on my doorstep with her OH, sending me threatening messages and harassing me. I had up to 20 calls and 50 messages a day ! She even told my new livery that had just turned up with her horse the most awful lies.

All because she obviously realised she was never ever going to get such a good deal elsewhere (she paid 20 euros a month in the summer).So denied the whole thing. She finally did move after a lot of hassle but the stupid cow put padlocks on all my gates so I couldn't get the horses out. Obviously was an inconvenience to me but soon sorted it out in a very short space of time. I hope it made her feel better though. :)

Moral of the story, you don't know what has happened, what this livery is actually like and why she is being asked to leave. I tried being nice and was doing best by my horse by finding him a friend. I helped this friend out, paid out of my pocket for this horse and ended up worse off. I had to get nasty in the end as I was being harrassed. This person was such a nutter though that I still fear for the horses when they are out in the field.
