Rental contract for private yard

Hi - i just want to pick your HHO brains.

A friend of mine who's not horsey has a property with stables, grazing and menage on it. When they originally moved in they had problems with original horsey folk so terminated their lease.

A couple of year down the line, they have been approached by new horsey people and my friend is keen to rent out their grounds. I've been asked to pop down and give once over from a horsey point of view, as they need to draw up rental contract.

What do you think contract should cover - Help

I lease my own land and stables from a Farmer. Don't have the contract in front of me here at work (and admit that it's a long time since I've re-read it), but from memory things on it include:

1. Farmer insists (and fairly so) that all animals kept on the property are insured for a mimimum of 3rd party public liability (BHS Gold membership covers that).

2. Specifies that (in my case - yours might be different) water is included in the rent. Electricity is extra and is billed to me quarterly.

3. Specifies who's liable for what with regard to wear and tear and/or damage to the property/buildings/fencing etc. (The basic structural stuff is down to the farmer - if I caused any damage then it's down to me). I maintain the fences generally, although the farmer would actually replace any permanent fencing which needed replacing due to age/wear and tear rather than damage.

4. Farmer retains the right to access and inspect the property at any time (or his nominated person).

5. If farmer wishes to do any work/maintenance/improvements on the property he will give me adequate notice.

6. Farmer stiplutes the maximum no. of horses to be kept on the property.

7. Agreed notice period - 3 months from either party.

8. Agreed method of payment (in my case monthly by Standing Order).

9. Rent reviewed and agreed annually, as is contract.

10. General stuff about keeping the place tidy and respectable.

There must be loads more, but I'm running out of ideas for now as I'm trying to concentrate on work too!
 
Take digital photos of the yard and facilities to show condition at the start of the lease and make sure the term 'fair wear and tear' is agreed........not that we've ever been caught that way!!!!:(:mad:

A clause about use needs to be included - ie no livery, riding school, dealers or as required.
 
You need to put a limit on the number of horses so as to avoid the paddocks being trashed in winter.

No sub-letting.

Third party public liability cover for £10,000,000 (Ten million pounds).

Mine is similar...but Landowner must give me notice of intention of visit.

also...I have to top the grass before the end of june and now sow anything without discussing with landowner.

...I have to give 4w notice but landowner has to give me 6 months ( she agreed to have this written in just for us)....

...Theres also something in there about the muck-heap....the farmer with the field next to us disposes of it so theres just stuff on there about keeping the heap tidy.


Theres stuff in there about control of poisonous plants ( eg ragwort)

I think its all pretty standard agricultural/grazing stuff.
