returning a faulty Ebay item.. advice please

Hi, hope this isnt frowned upon posting in here, it is a horsey item :)
It was bought via an Ebay shop on 28th Nov, it didnt arrive til 8th Dec. I contacted the seller on the 11th Dec with my concerns and they replied straight away with some advice. It still wasnt right but had been advised to try it a few times, then went on hols, then Xmas, so contacted them again on the 15th and have had no reply.
Its not a cheap item, what do I do? Is it too late now, initial contact was made within days and who's best to deal with Ebay or Paypal??

Your contract is with seller and not manufacturer. What are his return policy and warranty? He is likely was dragging his feet so you are over ebay return time scale
I would call to ebay explaining the situation, they probably advise you the best way.

Failing that, open a case on paypal.
 
Distance selling regulations gives 14 days to return an item and you dont need a reason, however if its not faulty, you pay return postage.
If item is faulty, and/or not as described in the listing, you get to have a full refund and the seller pays for return postage.
They generate a ‘return postage label’ for you to print off and affix to return item.

So is the item faulty, not as described, or just doesnt work how you thought it would?
The reason you dont want it is important.

If its just not working how you expected but there is no manufacturing fault or wrong item sent, and youre over the 14 day return period, you will have to sell the item on yourself via an ebay listing.
 
You contacted the seller of the 11th december and then got their advice, to try it a few times but you still found it wasnt right, but you left it 35 days to get back in touch with seller to tell them, which is way outside the 14 day period.
If its a manufacturing fault meaning the item has defected after the 14 day period, its a grey area, is your item the kind with any guarantee on it, like a horse rug of 12 months?
I’d go direct to manufacturer after 14 day period has lapsed if item is defunct upon using it.
 
In the UK, the liability is with the retailer who sold it to you not the manufacturer. You are out of time on ebay, but if you paid via paypal they will still help you. Otherwise, you can take a small claim against the retailer if they are UK based. If not, you're sunk, really, but worth trying the manufacturer if it's a good brand.

You have 30 days from the date of delivery to open a case with eBay. You have 180 days from the date of purchase to open a case with PayPal. EBay will provide a prepaid postage returns label. PayPal you pay returns yourself and you must upload tracking. PayPal are also running a promotions whereby they will cover the returns cost. I believe you must have registered for this before opening your case.

Ebays terms are much more generous than standard consumer rights.
The Consumer Contracts Regulations gives you a cancellation period that starts the moment you place your order and ends 14 days from the day you receive your goods.
You then have a further 14 days from the date you notify the retailer that you'd like to cancel your order to return the goods to them. With their standard 30 days, eBay more than comply with this regulation.
‘On eBay change of mind returns costs are your responsibility. Faulty goods or goods not as described, the returns postage is down to the seller. It seems like you are out of time for an eBay return but if you paid by PayPal you can open a case there. Good luck.
 
Thank you all. I did pay via Paypal and realise Im out of the Ebay 30 days, more fool me. It seems the seller who has a website shop too doesnt want to know now and probably knows their rights better than me lol!! I will try with Paypal as I wouldnt or couldnt try to sell it on. Hopefully not an expensive mistake!

The item is faulty, the retailer has a legal obligation to refund, repair or replace if they are in the UK.

Good luck getting it sorted.
