right of way issue ...help?

if you have right of way over your neighbours property (my mum and dads house at the back is in someone garden if that makes sense?? anyway to get around the back of their house we have to go through their gate. Do they have to tell them/get permission to say go around the back to work on the house? only they are not in any mums painter is whining about having to wait around, mum did tell lady next door but she said she was going out? any ideas other than waiting for them to return.

I'm sure as long as there is no dmage caused and the painter is only gaining access then it shouldn't be a problem.

Did the lady next door seem to have a problem with it?

Depends on access as stated on deeds
Is it a right of access at all times?

Guess it not day to day vehicle access though as our is, but has to be open at all times, and minimum with to allow for 'passing and re-passing of carriages'

Meanwhile, put down some dust sheets and painter comes through your house to the back garden and access


Or if it ther eis no back door,and it s rear/ side wall backing on to her proeprty,there is legal access as defined in the Party Walls Maintinance legislation.

Surely in the deeds of your house you have right of way through your next door neighbours property if that is the case then you would not have to ask permission! Well except for common curtasy (sp) letting them know a painter would be walking through!?!

this was what we were hoping was the case. my friend has a right of way on hers and I'm sure no-one asks her ... I'm going to nip over now and take a peek ! lol
