Rip Off Ebayer - Advice please?

Last night I bought a body protector on ebay. It was a fair price, Buy It Now £50, 4 years old but as new condition. I was so pleased I immediately went on to buy the shoulder protectors from an ebay shop to go with it (£39.95).

An hour later I get a message from the seller saying she had decided that the BIN was too low after all and I could either pay an extra £30 or she would relist with a BIN of £80.

Any advice before I respond as at the mo anything I say will be very rude and am trying to calm down and think of a rational response?
 
The ebayer is not allowed to do this, as they listed it at the price and you bought it. I would contact ebay straight away.
 
Once you click "commit to buy" - or win a bid - then it is a binding contract. The seller cannot up the price. You cannot refuse to pay. What you do now can be a bit tactical though.

You can point out to them that they cannot by the terms of Ebay change the price that way. They must supply the item at the price agreed. Hopefully they will then do the decent thing and send you the protector you bought.

However this is a sadly common scam and it is quite possible that they will send you a substandard product or something different. You then have to raise a dispute through paypal - do use paypal rather than another method of payment as the protection is better - but that is time consuming and you could be stuck with somehting you don't want and can't use.

You might be able to get a feel for what they are likely to do by looking at thier shop front and feedback. Are they a genuine seller with a lot of good feedback or are they new (suggesting they may have changed their selling ID recently) or with a lot of neutral or negative feedback? A well establoshed seller with a professional shop front and lots of trading history will be far less willing to put that at risk than a less well known or trusted seller.

Alternatively you can just report them to ebay immediately. They'll probably loose their trading rights - espeically if the request for additional funds can be proved through an email or something. But you almost certainly won't actually get the protector you paid for. If you already paid you'll have to rasie a dispute through paypal to get the money back. If you paid another way you will have to rasie a dispute through ebay and they take an admin fee from you!

Whichever route you choose do report them to ebay eventually. Sellers like this make the whole thing nasty for all of us.

I would ask ebays help as it is really only them (or an expensive solicitor) that can sort this out.

That is very low of the seller.
 
Yes I paid immediately by Paypal.

She is a new ebayer with zero feedback so she is using this as an excuse for changing her mind.

I want to reply with a hope of still getting it, obviously if I dont get it I will be reporting everywhere I can, negative feedback etc...
 
remind her of the terms and conditions she signed up to when she joined ebay and suggest that you would have no option but to contact ebay as she has broken the terms of her membership and you bought the item in good faith. High street retailers wouldnt do this or market traders so why should she??!

Ebay would not look agreeably on her behaviour as they are very clear on sales being binding agreements. She cant use the excuse of being new seller!

However I guess that she cant be forced to sell it to you (ie she may decide that she would rather never use ebay again or reregister with different username etc) so try the gentle approach, then a little bit heavier i.e. reporting her and then get your money back. Thankfully Paypal are pretty good at getting money back (I have had a couple of problems of items not turning up and getting my money back)

As has already been said, she can't ask you for more, when you clicked on BIN she has a contract with you. However as was also said, you can't force her to sell it to you. If she has no feedback I don't suppose she'll care if you report her, she can just open a new account and start again.
What was the BP? Sounds a lot for a 4 year old one at £50 never mind £80!!

"Well I will have no option but to contact ebay as you have broken the terms and conditions of your membership and I bought the item in good faith.

As soon as I had won your item I immediately bought a set of shoulder pads to go with it at a cost of £39.95 so I am very much out of pocket now. Also there is an identical BP on there with a starting bid of £35 and a BIN of £75, It has no bids!

Hmm, I wouldn't hold any breath in getting your body protector unfortunately.

I also messaged the seller saying the following:

"is this the same body protector you've solf for £50 and then, after the buyer paid, you asked for more money?"

Hence I declined !!

Agree with this ^^

Daughter is studying law as part of her degree and says that under contract law you now have the right to sue her in small claims court for breaking the contract.

Contacting Ebay and PayPal is a lot easier and quicker though :p :D

With no feedback it is quite possible they make a living at this. They have no vested interest in placting ebay or behaving decently. I know some people with no feedback are decent - but there is a reason established sellers will often not accept bids from someone with less than 10 feedback. Sad - becuase it tars every new user with the same brush and I'm sure most are actually genuine. But there you are.

You'll need to check paypal rules but you may not be protected as they don't cover sellers with feedback less than a set amount either. If you used a credit card through paypal you will have recourse from them.

Once this concludes you might want to post their ebay name here - although by then they may well have changed thier ID.

I've just seen my paypal payment is still pending and I have an option to cancel payment.

May be because theirs is a new paypal account or they have set it up with wrong email address?
 
She probably just hasn't claimed it as she doesn't want to go ahead with the transaction.
What a cheeky so and so.......at least new listing has been pulled.
I would threaten her with small claims, it doesn't cost that much to do it online.

Ok i am sending it to your address, it is also brandnew, never been used. Would appreciate it if you didn't contact ebay as it was a genuine mistake and i am not here to scam anyone or cause any hassle, just to try and get the best price i can. But it is yours by right now so sorry again will post it asap. x

Just read through and agree you did the right thing, although it can be a dauning minefield!!! Let us know if she honours the transaction as she says she will, I hope she does!
