I consider flushing out and chasing deer with more than two dogs to be classed as illegal hunting under the hunting act.

You consider it to be legal to flush out and chase deer with more than two dogs. Fair ebough but no one else does lol!

How do you correlate these two statements?

I asked you whether, putting to one side the legislation, you considered what you do to be hunting and you said no. Even taking into account the legislation, what you do isn't hunting.

That was with respect to the exmoor activities.

With regard to using dogs to disperse deer in a wood to protect the trees. TBH I am not sure.

However the law classes it as exempt hunting as you know.

That's why it says it is.

Forgetting for the time being the flushing out bit.

Would you regard the deliberate use of more than two dogs to chase a deer to be legal or illegal under the Hunting Act?

It is ILLEGAL to use dogs to chase wild mammals.

How many times do you have to be told!

Zageedy Zig claims he has found a new loophole in the law whereby more than two dogs can be deliberately used to chase deer.

This is an important issue.

If he is right then it would blow the Hunt Ban clean out of the water. I'm trying to find out the circumstances where dogs can still be used to pursue wild mammals.

If you're not hunting the Hunting Act 2004 does not apply. Even you don't consider it to be hunting.

What he considers hunting or not is irrelevant.

the law states:

"(2) For the purposes of this Act a reference to a person hunting a wild mammal with a dog includes, in particular, any case where—

(a) a person engages or participates in the pursuit of a wild mammal, and

(b) one or more dogs are employed in that pursuit (whether or not by him and whether or not under his control or direction). "

If he is chasing wild deer with dogs then he is breaking the law unless his hunting is exempt.

It isn't exempt because it does not meet any of the criteria for exempt hunting.

people take these laws far too far as I am sure you agree.

We both recognise that there is nothing wrong with me using my dogs to chase deer and it shouldn't be illegal. The only question is does the law make it illegal to chase deer with dogs.

If it doesn't then that's cool.

And how many more times do you have to be told to read more of the Hunting Act than the front cover. I would like to specifically direct you towards the provisions of Schedule One where it lays out in exactly what circumstances an animal may be chased with dogs.
