Saddle dilema .. am I right to send it back?

Hope you wise folks can help?

Had a saddle M2M, I got it 2 weeks ago, after waiting over 10 weeks for it to be made. The chap who made it came out and 'fitted' it to my horse. When I say 'fitted' he put it on her back and said its ok.
He left me with no knee blocks and said to give the saddle chance to bed in.
I tried to ride in it, and after a very unhappy reaction I jumped off. Had another go under qualified instruction - same reaction. Instructor hopped on - same reaction.

I havent paid for this saddle, but have contacted the fitter who templated the horse initially who says maybe my mare doesnt like the serge panels ... and can come out sometime in the next month to look at it.

I dont want to put it on my horses back again tbh ... I dont want a broken neck waiting for something to bed in.

I am within my rights to send it back? Or should I give the fitter a chance to put it right?

I would probably give them the chance to put right but not 'in the next month' I would want it immediately - as in this week, and not use the saddle until they come out. If they can't accomodate then yes saddle back and full refund.

I had a not disimilar issue a couple of years back with a saddler. Was looking for a saddle for my young horse and had seen a make/model I particularly wanted to try. Said saddler was their stockist but didn't have one in stock/demo for me to try. He talked me into a brand new MTM on the proviso that he would give me a full refund if I didn't like it when I got it.

Well I ordered said saddle and specified an upgrade in leather type. 6-8 weeks later said saddle arrived, not in the leather I specified. I told him there and then that I would be sending saddle back as if I was spending ££££ I wanted it as ordered. However as it was there I said I should try saddle before ordering another one.

It turned out horse and I didn't like saddle afterall, so as per our original agreement I said I'd take a refund. He wasn't happy. He had my money for the next 2-3 months supposedly trying to find me a 'suitable replacement' which seemed to involve ignoring email/phone and not offering a single alternative. As it was I ended up issuing small claims proceedings against him.

So I would say be reasonable but don't let things drag on too long!
