Hiya,

Im going to visit the stud that my mare is going to be sold to.. If I like the home...

He said he will give me half of the money once hes seen the passport and the other half when we drop her off. What do you think I should include in the sale agreement/receipt?? I havent done this thing before and I want to make sure it all goes smoothly, she means ALOT to me and I dont want anything going wrong!

Any advice will be appreciated

Not got any advice I'm afraid but going to be nosey about you selling your mare to a stud, as I have wondered about the same thing with OH's mare as she has a soft tissue injury in her foot and if she doesn't stand up to coming back into work (just starting now) I wondered about doing the same.
Can I be really nosey and ask if your mare is papered? If so what breed? Has she had a foal before? And how old is she? And will you buy her back one day when her breeding career is over?
Don't worry if I am being too nosey and you'd rather not answer my litany of questions!!
 
One of the main things with any agreement is an independent witness to sign it in front of both you and the other party otherwise an agreement is not worth the paper its written on! make sure the witness prints, signs, dates and writes their contact address on the agreement also.
 
As far as I understand it, selling horses (in law) is much the same as selling houses or cars. I don't think a sale agreement is anything that binds the buyer.

That mweans, once the horse is sold to them you have no legal rights or ownership anymore. What you put in the agreement might bind you - e.g. if you put no vices and she crib bites and rears, they've got come back on you. If you sell her and they sell her to someone else tomorrow, there is nothing you can do about it.
