Sale gone wrong-what would you do?

We recentley sold a pony. As the people lived a long way away it was done via pictures and lots of phone calls. We sent him with as much info as possible including the things discussed on phone regarding a medical issue that is perfectley managable and doesnt affect his performance. They didnt want to have him vetted however after he had been there for a week they rang to say he was fantastic to ride and handle everything we had said and more but they had let their vet see him and he said this condition meant he was seriously ill! so they were sending him back.We were very upset but i explained we couldnt afford to buy him back.Heard nothing until 3 days later their driver arrives with pony.I rang the purchasers and said i would take him off the lorry for his welfare but situation remained the same. They said fine we will talk soon. Four months on i still have pony -very fit and well and other than one phone call and letter requesting money and suggesting reduced amount for my trouble I am stuck with pony i cant afford or have the time to keep! Well done if you got this far! What would you do?
 
I'd ask them to either sign over full ownership to me (without me paying a penny) or ask them to take the horse back. If they caused trouble then I would start to invoice them for full livery!
 
I would send them a cheque for a reduced amount to what they gave - sending an invioce for what you have deducted - so they cant quibble and then stick said pony back on the market. (i would deduct a fair bit for the costs involved but be fair)

you cant keep their money and there is no point in boxing said pony back up to them as you cant force a pony on them.
 
They acepted that they were buying a pony unseen and were given the option of vetting - so totally there problem. Not really sure what to do with the pony other than tell them that if they do not collect the pony within four weeks he will be sold to cover Livery bills and any money left will be sent on to them. keep copies of your letter and send Recorded delivery.
 
Thanks thats pretty much much what the solicitors told me -its just hard because we think a lot of him and I worry where it will end cos i just worry in general!!! Pathetic i know!
 
The telling phrase here.....'we recently sold a pony'.

These people are fully aware of his condition and very happy with him and then suddenly they change their mind? Well im sorry but its their pony and if they want it to live with you they pay you livery!

I would offer to sell it on for them for a fee and charge them livery whilst its with you.

Cheeky buggers. Dont you dare buy it back off them. If it doesnt make what they paid then thats their problem not yours.
 
It was one of their suggestions that I resold for lesser amount but to be honest I am feeling v. disillusioned with selling and they want it sold by me not on their behalf but if their vet really said that (although mine disagrees) and last time I looked pony was still upright!!

i would not like to sell him without being totally honest and people would wonder what was going on !
 
They are totally pulling a fast one here....they just want their money back. Tell them straight, its their pony, if they want it sold then they sell it themselves and in the meantime they either arrange to have it picked up or you are sending them a bill for livery. End of.
 
Best of luck. Never nice having to deal with these things, but you are being taken for a mug here.

It's perfectly clear-cut in the eyes of the Law; they own this horse and as such are fully and financially responsible for him.

If there is something seriously wrong with the pony then it is going to be hard to sell it on to a good home. I would be concerned about your pony's future welfare. Perhaps you could speak with these peoples' vet to find out what his prognosis really is.

These people did not even bother trying the pony out or getting it vetted they were either naive or a bit silly, neither of which is your fault. If you did not have any agreement regarding sending it back if it was not suitable then they are not entitled to get their money back.

If you are confident there is nothing seriously wrong with the pony's health I would get a vet report stating this, and send it back to the people in question saying that you will try to sell the pony on their behalf but will deduct livery fees and a commission.
 
What's the saying ' Buyer be aware'. If they knew everything about him and chose not to have him vetted it's their problem. I would be adding up the livery costs and if they contact you again I'd deduct the livery from sale price of pony. Pretty sure they will actually owe you!
