Oh blimey. How awful. Hope she recovers well. I guess in terms of legally speaking, it would be hard for them to prove the horse didn’t just have a ‘moment’? Like all horses can ? Might be wrong there though.

I would imagine that they would have to prove that the pony has done this before, for the seller to be negligent.

No idea from a legal standpoint (and no comment on the dealer) but schoolmaster doesn’t necessarily mean ‘safe for a novice’.

My old SJ pony was a schoolmaster - point and shoot round a course of jumps, didn’t stop, didn’t run out, jumped anything. She took my son from 50 to 80cm almost overnight, teaching him about courses, walls, triple combinations, the lot. She was tricky to ride though and it took him a month to get the hang of her before I let him near anything bigger than a cross pole. Ride her correctly and she was an absolute dream, sit there with flappy reins and off balance and you would either be being carted towards the nearest jumpable object at great speed, or find yourself on the floor.

The parent should try to find out the history of the pony. Some are sold as companions due to veterinary issues. Dealers use false names and friends to obtain free to good home and low price horses which are then sold on as schoolmasters. If it is not on a copy passport previous owners can be traced, also posting pictures of the pony can help to trace it's past even if on a copy passport now. Sometimes other people who have tried the horse will recognise it or may have previous returned it to this or another dealer after having problems.

If it is still being advertised I would get a friend to call and ask which pony club it went to and go from there as a start.

I liked the look of one of his horses a while back, quickly decided against it after some reading up on him. Poor girl, what a rubbish thing to happen

Her parents should consult a specialist equine solicitor and instruct them to take action against the dealer who if they are reputable should be insured for incidents of this nature.
