Why is it when you sell a horse people are so suspecting and blame you for anything that goes wrong
i sold a gorgeous horse to a lady who tried him once and i asked if she wanted to try him again and said i trusted her experience that he would suit her daughter(daughter did not come out to try him)
This horse i ride every day and lead babies from him and he is great , my daughter rides him and my mum and a few people that tried him
a few days later she says she fell off getting off him and he is unsuitable so i went to ride him and she was feeding him rich grass and haylage and feed and had not riiden him for the few days
i dont know how this can change a horse so fast but he was really unsettled and different , i rode him for an hour and he was good , walk trot , canter and on and off on and off , now she wants to sue me as she says she was hurt when she fell off getting off him
When is this going to stop? surely when we buy an animal we are responsible for our decisions and if a horse is unsettled blaming the horse is so wrong
I feels so sad there is so little good horsemanship around nowadays, no wonder all the natural horsemanship people do so well teaching people but i wish everyone had to take a course before they purchased a horse
 
It is because of situations like this that I feel that the 'Is this a landmark case' thread and others like it are so important. As you say, where will it end? We need some clarification on this. Everyone's idea on experience, feeding and management varies, so with change comes unsettling for the horses. I think you should probably contact the BHS and discuss it, but to be honest, I don't think she has a leg to stand on.
 
I'm happy to keep in touch with the people who have ever bought a horse off me and glad of the updates (good or bad) and the offer of visiting them once they are settled. Touch wood i have never had anyone wanting to return a horse etc
But unless your a dealer that offers a returns policy or have a written agreement then surely once you have sold a horse and money has changed hands and they drive off the yard then that horse is their responsibility?

If i bought a car privately and a month later it broke down wouldn't go banging on the sellers door saying they sold me a lemon...?

If you can or want to you cold offer to take back the mare but to be honest like others have said, I'm no sure she has a leg to stand on.
 
OP I was in a very similar situation 3 years ago. Same senario mum trying pony for her children. She said she was very experienced only tried her the once. She didn't fall off though just said pony didn't hack out alone, incidentally she did when we owned her. She sued me and won, the court system was a farce and I would never sell a horse private again. I'd send them to a dealer first and lose the money than risk the stress I was put through.
 
Omg!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! The fact that you went to ride him imho shows you felt you'd sold a decent geniune horse!

She probably didnt injure herself by sounds of it and is looking for an excuse to sue! Sounds a little wierd to me that the actual rider didnt come to try him!
 
It dozen,t sound like she gave the poor horse time to settle in and get to know them. A lot of horses become unsettled in a new place and just need to be reassured and allowed to settle ect. The worry I would have is where he,ll end up, they don,t sound like the ideal place obviously lack experience. Some people seem to think they are buying a bike!, not an animal with a brain!

I would just suggest that she changes his feed, and allows him to settle. She needs to be fair on the horse. If you can do it and feel so inclined, I would also pop out and ride a couple more times, to help settle your horse in.
 
Not being funny but what did she do to fall off getting off :eek: perhaps she should look at her technique and what exactly is she going to sue you for? Being a pratt? Being humiliated by a horse (she better get used to that) Did she get off awkwardly and upset him so he moved because after all he is a living breathing thing. Blimey when will people take responsibility for their actions, riding is not a sport for pussy cats, really take up something less demanding like watching soaps or stamp collecting. Makes me so mad.
