I haveposted a few times on this subject , My small claim is progressing slowly but surely and I just wondered If any of you guys would like to share with me your Success stories / victories re this ?????

Hi there , With regards to my recent post about the VDS and my small claims action route against the vet in question .
I am in Dundee, Scotland and my small claim action case in with Colchester county court at present .

I am hoping to get a few peoples success stories to use as successful , test case style examples to provide to my judge
like the Vets are providing 50 year old example cases of claims not being successful !! they obviously are not going to tell the court of any or all the cases that do haves success .

I was just wondering if you would be interested in doing so ???

If you would like to email me or write to me with a brief summary of your case and the successful outcome.

Ie , so that I can quote in my particulars of Claim , a couple of examples possibly including yourself maybe something like this :

****** " such as in the successful case of Mrs A N Other vs A N Other Vet group, Yorkshire County Court , 2007 " *****

If anyone would like to help that woul be brilliant , If not then I have a couple of potential volunteers so will se how it goes .

Sorry to say that I doubt you'll sue a vet successfully. A vet vetted Ty (5 stage) and passed him dispite the onset of hock spavin and being blind in one eye. The VDS said that an expert witness should be allowed so it progressed to fast track which meant a possible £20k liability in fees if I lost so I backed down!

QR - the OP is far to vague for me to comment specifically, but I do think it is quite possible, and reasonable, to sue a vet who was completely wrong when they vetted, and passed, a horse that was clearly unsuitable or unsound for the job that the buyer specifies.

thank you for the pm, but i wonder if i mention the vets that i claimed against.. cant say sued i jsut disputed there actions, care and treatment, and then refused to pay the bill, i didnt want any thing off them it was a matter of princable.

BUT i do wonder if mentioning their name, and the courts details etc would have any reprocussions. for that reason im hesitant.
