Shelter problem

Hello all
Hoping I can gain a little advise from some of you. I have my ponies in a field at the side of the house and the field is grazing land. I've recently had a shelter put up (open fronted) and the Coucil have complained. Now I'm a little annoyed as I made sure the Shelter was tucked away and not obscuring any view and designed it so that it can be dismantled in about an hour.

My question is this. Everyone is saying just put the Shelter on skids and the Council can do nothing. I want to know if it's worth doing this rather than having to pay £85 for every application to them.

The council have even made a comment that it shouldn't be used for horses (land and shelter), but am I right in thinking horses can graze the land as long as they are my personal horses.

Do I need to change the use on the land? Anyone done this?
 
Horses can graze agricultural land without permission for change of use. It depends what area you live in as to whether a mobile field shelter needs permission or not. If you are in an area of outstanding natural beauty or special interest then you still need permission, even if its mobile.

For what its worth its probably not the council who noticed the shelter, i bet a neighbour has complained. You can check your file at the council office to find out who!
 
Have you discussed the options with your Planning dept?
It's all very well members here giving advice, but each circumstance is different, depending mainly on location (should all be the same, but it's not)
 
I do know who complained about it as we only have one neighbour - I live in the middle of fields with a neigbour just across the way. They admitted it was them that reported it.

We are covered by Stratford on Avon District Council and it seems a lot of people have had trouble with them hence my concerns. They have planning pages on their website, but it lacks anything regarding Equestrian or Agri. All I can get from it is that if it's a Riding Establishment then the ground has to have Equestrian use.

If there is anyone who's gone through some of these processes then I really would love to hear from them.
 
you need to go and have a meeting with the planners, various areas seem to enforce different rules...

you can graze horses as long as you don't give them any supplementary feed, i was told!!! (as if it makes a difference if the horse is existing on grass, or gets extra hay or hard feed?!) surely that becomes a welfare issue if you daren't feed supplementary feed because of Planning laws?
i have skids on my shelters and when the planning person came to check my manege, she looked hard at the 3 shelters (all large, 16' x10) but said nothing...
i think they are so hard on permanent shelters because if they are in situ for a certain amount of time you can then apply to turn them into something else, whereas mobile shelters do not allow this.
 
You will need a change of use on the land come what may if it is agricultural use. Unless the horses are not used for leisure...i.e. you ride them and have them as a leisure rather than them being used as grazing animals such as cows and sheep. Horses that are ridden and fed supplementary feed to the grazing alone need to be in a field with equestrian use on it.
If I were you I would eat a big dose of humble pie and have a meeting with the planners...invite them over to the site and get them to advise you on what to do and what is likely to be acceptable to them before you put in the planning application. You really do need these people on your side so need to involve them and tick all the boxes they require. If you go ahead without planning and put up a mobile stable on skids they will ask you to take it down and you jepodise your chances of getting any planning permission...I would not advise you do this!
 
Unless you're with the travelling community, then you can build little houses, put on a dozen mobile homes, build a six stable block with hay barn. Oh and you can even throw your muck on the grass verge outside.
All without planning permission

Or you can live in a rural layby complete with your own portaloo and not be bothered by the local council. Travel? Nah, the ones near me have been there well over 6 months.
 
Thanks guys. My ponies are not ridden at all and are here as retired pets.

I think I'll need to get in touch with the Council then - uugghhh!
