Should the person who is loaning your horse have the passport?

I have had my section A pony on loan (until payed for).Had her 6 years and still no passport,she wont let me have it.So called owner told so many lies that I wouldnt trust her a inch. Long story.
By law passport should be with pony,but its not and there isnt anything I can do about it.

Yes, the vet will need to confirm that they are vetting the correct horse by confirming the identity. A passport is not proof of ownership and will be needed should the horse need to be transported anywhere.
