ok, in respect of appeal against sentence - this is an open which is open to the defendants. The DJ only barred them from appealling against 10 year equine keeping ban for first 5 years of that ban. If they did apppeal against sentence, it would be open to Crown court judge to increase sentence given (to maximum of 26 weeks, which is true 6 month sentence) and also to increase costs award to include costs incurred by prosecution in attending appeal against sentence.

JG already has £3k costs order from civil injunctive proceedings in high court re his failed attempt to have equines returned to him.

Even if JG has transferred ownership of farm to another, unless this was a transaction "at value" (ie sufficient amount of money changed hands) then this would be set aside and would still be treated as an asset. he will have been given a certain amount of time to pay after which time it can be enforced. If he declares himself bankrupt, again any transaction at undervalue would be set aside and the farm would be deemed to still belong to him.

hope this clears a few things up. shame prosecution didn't come a bit later on this year as law is about to change and maximum custodial sentence will be increased.

As for the trolls, lets hope they return under whatever bridge they came out from....

It's true he has been released on bail pending an appeal - it's how the law works. It doesn't make him innocent and hopefully following the appeal he will be back at Her Majesty's Pleasure

Will the judge at the court of appeal have the power to impose a larger prison sentence?
 
Just had it confirmed from a neighbour (who also happens to be a magistrate) that because JG has appealed (and because his prison sentence was short) the law dictated that he had to be released on bail pending the appeal.

I can assure anyone that might be concerned, that today's event is in no way a victory for James Gray...it's just a general, legal formality that no judge had the power to overturn. So quite honestly, I'm not quite sure what Patty is so overjoyed about...after all, it was common knowledge that JG would appeal.
