Terms of contract when buying shetland, not happy with...

I would ask a fluent French and English speaker with some French legal knowledge, who can advise you whether the wording of the contract is usuall, or if the seller has decided on some odd wording of their own. If the latter, maybe you need to think very carefully.
 
I've had 3 horses on trial and never damaged any. I've sold a horse privately and it was as described. Got sued and lost ! Things are not so black and white I'm afraid. Try the pony as often as the owner allows until you are sure he/she is perfect for your child. And good luck.
 
Is your seller in France? French law is completely different from English law. You would need to get legal advice, but as far as I understand it you can return anything you have bought in France within 14 days of buying it (including a horse, a house, etc.). Registered French breeders also sell with a standard contract which obliges them to take the animal back and refund under certain conditions (e.g. genetic disorders) at any time in its life. The police are much more likely to get involved over here as well especially if someone sells an animal which turns out to be dangerous especially if the animal was intended to be used by/be around children.
 
If you do agree to the terms, just make sure you have written down a list and make sure you ask if it cribs, weaves, box walks, bites, kicks, is good to box, shoe, catch......
if she/he has sweet itch. Has ever bucked, reared or bolted and has the pony ever bitten a child or kicked at a child or a dog?

I know some of these SHOULD be declared...... but you need to ask anyways.
