Foxfolly: It is up to the breeder to ensure the pups are not sold to pet homes if you opt for docking at birth. If an RSPCA, Vet or Police member stumbles across a 'docked' puppy out walking with its owner or gets a report from another member of the public they can insist on the breeders details then take the matter to court, this is why you, as a breeder signs a consent form declairing that the pups are going to 'working' homes before the Vet is legally allowed to dock them. I know it is also common practice in some breeding homes for the breeder to dock the pups themselves but this is totally illegal.
 
No thats not true!!
All our pups have a certificate that state they are legally docked, that is all they need to produce if anybody stops them!
The only thing that it says on the certificate is that they are intended to be worked but not that they will definitely work!

What would you do with a dog that didn't want to work if that was the case?? Not all dogs bred to work actually enjoy it? I know of many a working bred gun dogs who won't work as they are gun shy!!!
 
All puppies that have docked tails have to go to working homes - period! If they prove to be unsuccessful as a working adult then so be it but as a breeder selling a puppy you must ensure if the tails are docked that the home is a working one and not primarily a pet home. We own a Veterinary practice so we have all the up to date guide rules on docking. Incidentally, we have just be involved with two court cases for this exact reason, 1 for a litter of JR's and another for a boxer puppy.
 
I don't see anything in the law that says they have to definitely work, you cannot possibly have that as law due to the fact that you must dock by 5 days old. If we advertise our pups as working terriers which is what they are, we have fulfilled our part as we have shown intent to use them as working dogs... which is what they are!!!

Extract from wording of the law:

The exemption for working dogs allows a dog that is likely to perform certain specified types of work to have its tail docked by a veterinary surgeon. The dog will have to be less than 5 days old and the veterinary surgeon will have to certify that he or she has seen specified evidence that the dog is likely to work in specified areas. Puppies being docked must be microchipped, either at the time of docking or when the vet considers they are old enough. The types of dog that are allowed to be docked and the types of evidence needed, is detailed below.

Puppies from certain working dogs may be docked if evidence is provided to the vet that it is likely to be worked in connection with law enforcement, activities of Her Majesty’s Armed Forces, emergency rescue, lawful pest control, or the lawful shooting of animals. It is accepted that in a litter, not all puppies docked will be found suitable for work.

The owner of the dog, or person representing the owner must make a signed statement that, the dam of the puppies to be docked is of a type which can be certified as set out below, the date on which the puppies were born and that it is intended that they will be used, or sold, for one of the working purposes set out in the regulations.

Note it says 'Intended' to work NOT that it is adamantly used to work!!

I don't want to get into a big debate about this but to be told I am acting outside the law obviously is very concerning. Especially as we did ensure with our own vet that we were still allowed, I am relieved to see that we have got the law right!!!
