Think I've been had - Ebay - what to do next?

[ QUOTE ]
Paypal said that in their terms and conditions - if the seller leaves them money in their account, it will be refunded. however, if they take the money out of their account, Paypal can only refund a max of £50.
The police said if this was their terms and conditions, there is nothing they can do! So basically, hell mend me! It's so infuriating when the people who are meant to help you in these situations, ie. the police or paypal, do nothing!
This was 3 years ago, I haven't used it since. I now want to sell a Barnsby saddle on ebay, but I could never ever rip someone off like that.

What a shame that you didn't contact your credit card company (if you paid by CC that is) as any transactions over £100 are covered with them. They would of refunded your money in full

I know, after reading these posts I now feel so stupid.
I now know I should have been much more careful, I used my debit card and my company would not look into it.
I opened a credit card account because of this reason, and I shop online all the time now, but I'm really wary of ebay. My friend uses it all the time for horse stuff, buying and selling, and has never had a problem.
I might 'sit in' with her and learn some night, I hear there are often bargains to be had. I will be printing this discussion to follow everyone's advice!!

Don't feel stupid, unfortunatley we only realise how we would of been covered when its too late

I always use a credit card online for extra security now. I also used to think that Debit cards were covered under the same rules. I use Ebay occasionally, hubby uses it all the time and doesn't have any problems at all

Thank you Mollywops. That is very clear. I have been sending the seller messages and emails and have at last got a reply. Saying that I should receive the saddle by Monday, even though on her listing it said she would send it by 24 hour service. I have replied asking that she honour the delivery so that I get the saddle by the weekend, especially as I paid immediately the auction ended. I rather think she is using delaying tactics - so should I wait until Monday and see if I actually receive the saddle or not?

If the seller has promised you will get the saddle by Monday, demand a tracking number to you can see if she has honoured her word and sent it, otherwise open a dispute.

Good idea! Have just sent her a message asking for the tracking number - will wait and see if I get a reply.

That's horrible.

There are a lot of twats on e-bay. It really is touch and go.
I have bought so many things that have never arrived, fakes, not described properly etc..
I always buy buy it now stuff, brand new and read all feed back.
You really have to trust with e-bay, that's the problem.
I was going to buy a stübben bridle, until there was a thread about it, saying people bought cheap bridles and added a stübben browband to it instead of it being the real thing.

File a complain against this ass hole and give him the worst feed back ever. Sorry to hear this.. just goes to show no everyone is as true as you think.

I've been using Ebay for a number of years now and so far - touch wood - have not had a problem yet. Apart from once where the wrong addy was displayed for a seller

but that was sorted once we realised what had happened.
I tend to be wary of all sellers and read feedback carefully before I bid

Regardless of what she says, I'd still open a dispute (you can always call the dogs off if it comes good) and if you haven't got your saddle by Tuesday, escalate to claim.

Echo that - a very good idea

Echo number two.

At least then you've more of a chance of the funds being frozen. Even if the seller has initiated a transfer of funds to their bank account, if it was done in the last 2/3 days, PayPal will stop the transfer.

You will not get all your money back - Paypal retain some for the "work" they have had to do.
If you paid using money that was already in your paypal account, you will be limited how to get it back. However, if you paid using money that came from a credit or debit card directly into your Paypal account to pay for the saddle, then your bank will probably have some scheme in place to insure you against non delivery of items.

Always clear your Paypal account out before paying for a large item - it is far safer this way. The bank will either pay you the amount that Paypal doesn't cover, or just cover the entire thing. I have done this twice.

Presumably you have an address and phone number so why not call them - you can get this information from ebay. It may also be worth doing a small claim. Paypal and Ebay do not make the process easy as it is hassle for them - so hopefully you can just approach your bank and do it that way instead.
