Hi all just looking for some help....

I took a deposit for my horse I am selling on the 1st of this month (10% of horses value ) and was promised payment the following Friday.....the payment never arrived....was promised "Tuesday at the latest" well the date has gone and still no payment...

I swallowed these in good faith and was promised payment by midday the next day.....still no payment.

Am I within my rights to re advertise the horse as it has now been nearly 2 weeks since the deposit was left ( and I've spent money on 2 weeks livery feed bedding etc) and 3 promises of payment have been and gone.

The horse is up for a VERY low 4 figure amount

I really don't want to be "harsh" but at the same time the circumstances of the sale were made clear and I stated I needed a quick sale hence why I dropped the price (by over a thousand)

Any advise appreciated

I would write a letter and send it recorded delivery stating that unless full payment is received by XX date then the deposit will be forfeit and the horse will be re advertised.

I'd also sent the message via email and get a read receipt on it

I think two weeks is a long time. I assume then that she hasn't had him vetted? I thought I was pushing it with 4 days between vetting and collection, but at least I'd paid in full! Are you sure this is the right buyer for your horse?

They have already broken the terms of you agreement, contract. I would send them text email etc and say if it is not collected by X date with full payment they forfeit their deposit.

I would just tell them that they have broken the terms of the agreement and the horse will be readvertised immediately and the deposit withheld to cover the 2 weeks keep and advertising costs.

Sounds like a lucky escape for the horse

Yes, re advertise. Send an email/text/letter to say you are re advertising as never received the money.

Either they do not want the Horse anymore and are to frightened to tell you. Or they generally like and want the Horse but cannot afford to pay for it just yet, in which case you wouldn't want your Horse going there anyway if they cannot afford it.
