As opposed to loan or sell.

Anyone done it? Good and bad experiences please

I'd guess it means you sign something to say they own the horse (or whatever) and you transfer all rights/responsibilities of ownership to them for no payment? So it is like selling your horse for no money?
 
My friend transferred ownership of mine over to me a few years ago. As we were good mates and I had been riding him for over 10 years it was totally fine - signed a document witnessed by another person and got a passport in my name. Not sure if I would have been as happy doing it with someone I didn't know.
 
i have 2 that were gifted to me, first one came on loan first but when her owner knew that she wouldn't be in a position to have her back in the forseeable future she signed her over to me for £1, done in writing and signed by witness' and with the added term that it was on the understanding that i did not sell her on. second one was gifted to me without being on loan first, again for £1 and there is a clause in the agrement that he can't be loaned or sold without previous owners consent, whether that would ever actually stand up in court i don't know, not that it's an issue as he isn't going anywhere anyway lol.
Of course if you are the one gifting the horse i think you have to be aware that once they are out of your ownership that you don't really have any control over their future, if the new owner moves the horse away and doesn't keep in touch you have a slim chance of keeping tabs on what happens if they decide they want to sell or have the horse pts.
i love my 2 and wouldn't part with them for anything but i'm sure there are plenty that take horses on with al sorts of promises with no intention of keeping the promises or even the horse

I haven't dealt with anything like this myself but in legal terms I'd think of it like a loan agreement but more solid. If you want it concrete have a solicitor draft one for you. I will assume you are thinking of gifting. I would make sure if you are the one gifting you say in an agreement what should happen. You can say the horse has to be returned should the new person not want the animal at some point in the future. If it's in the contract they've signed they have bound to those terms so it is legally binding in the same sense that a signed loan agreement is. You could say you'd like them to keep in touch with you but you can't enforce that. You cannot control how a person looks after an animal unlike how it can be worded into a loan agreement. Alternatively and safer for you and the animal how about a permanent loan basis.

Permanent loan is a safer option if you wish to retain control on what happens to the horse as people will say anything to get their hands on something for free. As was sadly proven in the case not long ago of retired horses being taken and then sold on unknowingly to the ex-owners many of them were not traced and the ex-owners have no idea what happened to them believing them to have gone into retirement for life.

I wasn't going to reply to this but heck, here we go, in for a penny in for a banning most likely, and for those who haven't a clue what this is I do apologise but if you were me believe me you'd not say nothing neither....! LOL in the contract you mention that we both signed, it says he's to be offered back to me first before he's either loaned or sold (and the latter won't happen), that was put in to protect his future, a safety net for HIM that I insisted on, which YOU agreed with too, after all I'd had him over 6 years from a weanling, I didn't want to gift him and have him sold on a year later and no idea where he'd gone, is why didn't sell him remember to those who wanted him, and there were plenty who did! LOL

to your other wondering yes it will - as well you know why! LOL tho I'm sure you'd never ever sell/loan him without offering him back to me would you like it says, but like you say you've got him for life so standing up in court won't be an issue for you will it, not with regards to him anyhow....

Shame you did not stick to your sign contract when you had a gifted horse PTS without letting the owner know.

Mud sticks I am afraid and the internet is a very small world.
