my horse's field backs onto a block of flats, but the fence is our fence, there is a gate on the fence and people keep coming through it, into out field? We have tried blocking this gate of 3 times with wood and fencing, but it keeps getting kicked in? What are my rights?:confused:
 
If you could catch them in the act of damaging the gate then that would be criminal damage and you could report it to the police. The act of trespass is a civil matter and it would be up to you to take private action through the courts.
 
Take away the gate? You do have to be careful because I believe that if someone has accessed what they believe is a footpath for a extended period they could have ongoing rights to that access. Get rid of the gate and add barbed wire to fence line at that point.
 
We have before and after photos of how we have tried to block the gate off, would it be worth informing the police of whats going on, because we are concerned of our 16.3hh ardennais horse injuring somebody, because he quite often has a mad 10 mins in the field, where he is charging around bucking and rearing, this usually occurs when somebody enters the field.

Make sure you have public liability insurance in place, it doesn't matter whether they are legally entitled to be in the field or not, if your horse injures them then they can sue. Perhaps report the criminal damage every time it happens just so that it is logged in case of problems later on, at least you will have a crime number to back you up.
