Hi folks,

As some of you will know me and my husband have been searching for a horse for a while. We've found one we like, but have one or two reservations. The owner is very understanding and has offered us a trial period so that we can see how we get on with the horse. I'm inclined to take them up on this, and if we do will want to make sure that everything is dealt with properly and down in writing.

So my question is, what things do I need to cover off with the owner and what do I need to consider.

Final price should you decide to buy him, notice period for return (for both sides), length of trial period, what bills you are liable for whilst in your care, what not liable for, what you can use him for (& not) etc just like a loan. I would download a loan agreement & modify it. Basically you can loan him for x number of weeks/months, then you either return him (giving suitable notice) or buy him at the pre-agreed purchase price.
 
Yes, I would have a loan agreement in place and also make sure that the horse is fully insured with you inc. loss of use.
 
Pretty much as pip6 says. I had my pony on trial for 4 weeks before I bought her.

There was an agreement in place that stated:
the trial period
final purchase price of the pony + details of deposit already paid
inventory of tack
details of the pony: height, colour etc
who was responsible for what costs: livery, insurance, shoes, vets bills, transport
level of insurance

Also, if the horse is travelling any distance to get to your place, you’ll need to have the passport. So we had it written into the agreement that although I had both the pony and passport, the ownership remained with the seller.

You could also consider using an ESCROW (think that’s how it’s spelled?!) service where you use an independent account to hold the ££ for purchase of the horse. This can give the seller peace of mind, but by the sounds of your situation they’re pretty happy already.
