Update on bucking new horse

Find out how many horses she has sold in the past 12 months. This is what denotes whether she is private or dealer. Nothing at all to do with whether she makes her living from selling horses.
I am with you on the not wanting to get back on bit. If you are not comfortable with riding the horse, then why should you get back on. I can understand everyone elses stories of how awful they were until the horse was settled in, and I can understand a couple of high spirited bucks. But if the horse bucks EVERY time it goes into canter, then there is a problem - whether it is physical or mental.

I would wave bye bye to the £1500 and get £1500 back and be wiser in your next choice.

I know that I am the only person saying this, but if you are not enjoying the horse and can afford to lose £1500 then just send the horse back. It is NOT giving up on the horse - it looks like it was missold to you.
 
Private sale or not, it can still be taken through small claims;

The parameters for a Small Claim are:

Up to £5,000 for claims not involving personal injuries.
Up to £1,000 for claims including compensation for personal injuries.
The claim to be adjudicated by a judge in chambers.
Court fees can be recovered.

Making a Small Claim
The Small Claims procedure starts with the completion of a standard form. This details the substance of the claim and who the Claimant and Defendant are. On completion the form is returned to the Court office with the Court Fee.

A summons will then be sent out by post to the Defendant who has the option to:

Admit the claim and pay you in full
Admit part of the claim and pay you in part
Admit the claim (or part of) and request to pay you in installments
Dispute the claim in its entirety

If the claim or part of the claim is disputed the matter will be set down for a Court hearing.

I do think like others you have not given her enough time to settle. I would also get the camcorder out & get this on film along with dates. Then you will have documented evidence of the incidents. Good luck
 
Actually, the camcorder idea is a good one if you can bring yourself to get back on. It is sod's law that as soon as she is on film, then she will refuse to buck. And that HAS to be good news.
 
....providing OM still has proof that the horse was sold as whatever and that the horse is not what she thinks she has bought.

Small Claims isn't actually as simple as some would believe, particularly when it comes to issues over horses.
 
I have some sympathy with the OP. Having been in a very similar situation I wish I had sent the horse I had back and not spent THOUSANDS trying to get to the route of his behavioural problems before calling it a day and having to completely cut my losses having been put in hospital several times by him.

I'd encourage the OP to go with her gut feeling whatever that may be- if you know this isn't the horse for you go through small claims to try and return it and get your money back- if not do as others have suggested be back/tack etc etc

Totally agree with peoples comments regarding settling in 100% but I'm now a complete cynic and the fact this woman offered a trial but then will only give half the money back sends alarm bells deafening my ears.

how many times did you try said animal before parting with cash?

how long was it with you before it started bucking?

if it didnt when tried and you didnt buy the saddle it was tried in, then IMO opinion you have a tack problem.
