URGENT advice needed re. shared ownership!!

Hi

I have been renting a yard since last october which was taken on with the aim of establishing a livery/rehab business. When I first moved in the prospective landlord very strongly gave me the impression that he owned the place (as one would assume anyway). A few weeks later he admitted to not owning it at all and admitted he was a tennant himself!! This was a huge shock however at that point he assured me he had an agreement to purchase the property with the actual owners and that he could be there for 2 years. I had already put in so much time and money that I carried on building up the business and successfully got it up and running and full in 4 months! about 3 months ago I was told that the property was on the market and it was being advertised!!!!!
This straight away created difficulties when it comes to being a livery yard!!

I am leaving next week however the issue is that me and landlord own a horse between us. He had agreed verbally that I could take her with me and settle up with him for his share when I had the money or when she was sold. Today however I had to leaave a message with him as I discovered he had mown a lot of grass in one of the paddocks i rent and currently have a horse in!!!! I am having to use this field as the others are riddled with ragwort or the fencing is shocking (things he should be obliged to do). After messaging him voicing some concern over him having done this things have taken a turn for the worst! He is now saying that I need to give him the money before I can take the horse on saturday which is money I haven't got however I after recent events I would not less this inexperienced person look after a gerbil!

I can't leave him with this horse she is soooo cute and deserves to be sold to a knowledgeable loving home where her potential can be made the most of.

What do I do though??? Any viable way round this???

bad situation all round!

tell him you will leave the horse if he hands over HIS share of the money to YOU on saturday. taste of his own medicine.
 
I would do but I feel like i am in a position where I would forever feel like I had failed the horse by leaving her in his hands. Although he isn't cruel he is extremely ignorant especially to the detriment of his horses. I mean I have to always add LOTS of water to his sugarbeet, nag him to worm his very underweight horse when he has already been told to 6 weeks before by the vet etc etc.
 
i wouldnt for one minute think he'd have the money by saturday and want to hand it over, it sounds like he's just laying down the law for a horse you BOTH own, so i just meant dont let him have it all his own way. just the suggestion might make him think?
 
I wish that were the case but he would more than likely have the money and has said he will buy me out :-(

I feel bad as I found the horse and I just don't want to leave her there but because of the problems he has caused I haven't got the money to just buy him out. Also he will owe me a fair bit in deposit which I suspect he will not be forthcoming with even though the place looks better now than ever
 
I was thinking of that but it is difficult as I don't know how determined he will be that I don't do that! I think as far as the law goes as well I would have to inform him of where she is going to be. I am going to see if this is possible though but suspect he will just be awkward and say no!
 
Blimey, do you always believe everything people tell you? You set up a "business" without seemingly having done any homework and then wonder why things went wrong, and shared the purchase of a horse with a person who you already found out was less than truthful and by your own observation, was a lousy horseman. Even though the place was a tip, you carried on staying there AND advertised it as a livery yard - did the ragwort and poor fencing not worry the would-be clients??? I'd love to know where the insurance would stand in the event of a claim as I bet the landowner doesn't know it is being sub-let. Sorry, but this doesn't add up at all.
 
The place is not a tip and was actually a nice place once a lot of decorative work had been put into it! The fields without appropriate fencing have not been in use for and of the horses staying so the ones in use have been fine. So really much of it was made of a high standard due to the work I put in. After finding out he didn't own it I was reassured that they had a long lease on the property which I believed due to the efforts they went to to assure me that all would be fine. The horse was purchased/rescued at a time when we were getting along. We had partnered up on horses before to great success as it gae me more opportunity to work with more horses and not to worry about financial constraints.

The landowner is aware that it is sublet. If there was a claim from one of the horses under my care whilst renting the premises I could be in trouble insurance wise especially if it something so stupid!!! It would be up to me to pursue action with the landlord.

The main reason I have tried to get out asap is that I was assured that the landlord was purchasing the place and it was going to be a private sale.......then i saw the advert in the local newspaper!!!! I know having run/been a livery for years that noone would want to be on a yard where things were in such upheaval as I wouldn't!! So I stepped back from it gave my liveries ooodles of notice and that was that.

The landlord is a truly deceitful man who lives in cloud cuckoo land. I just wish i had stopped believing his bull**** sooner!!!

Seriously?

He had already lied to you so why on earth did you not demand some written evidence of this before ploughing more money into the place?
