Looks like there is no verification needed now! its apparently happening as reported by H&H main site!
 
No problem, just wanted to verify the source not more information. As far as I understand from who I have spoken to, the powers that be were going to let this morning happen quietly and release relevant information after the event in the endeavor to avoid speculation or the potential to jeopardize anything. Securing the animals has to be the priority.
 
Sky news had reporters Live at the high court a few moments ago!! Wonder if its worth emailing them and asking if they know a verdict - or did they actually know this was happening at all consdiering it was kept so quiet!
 
I've got news!!! Please don't ask how I know.

It's been reffered back to the district judge as the High Court Judge didn't feel he had juristiction to hear the case. So for the moment they are safe....
 
They're only safe until next Friday. We're not much further forward. Keep writing to the Judge - absolutely vital. I've already written to him, but can do so again, and I've written to the Prime Minister, the Lord CHancellor and my MP, and the Jonathan SHaw, and Lord ROoker. and get those signatures on the petition.
Keep them coming.
 
Well I'll be there, I'm guessing it'll be at Oxford Magistrates Court again. Much easier to get to than central London!

As soon as anyone can get a date for the next hearing, presumably in Oxford some time next week, let us know.
As long as it's not Monday or Tuesday morning, I'll be there.

There was nothing on the news about the court hearing either! Doesn't mean it wasn't true! Would have thought the media would have been a bit hotter on this one!
 
I can't find anything on google either. I'm sure it's all true and just being kept quiet, but its very frustrating!

Exactly the question I've been sitting here asking myself. Why so quiet and who is "hushing it up"?

After the media reports over the past couple of days re. the ponies being returned, I would have thought that the media would be straight on this.

It just makes a joke out of our animal welfare laws!
 
Well you would think so, but maybe they're worried (whoever "they" are!?) about an unfair trial etc. Only reason I can think of.

Statement from the RSPCA -

Future of Amersham Animals Hangs in the Balance

A High Court hearing to decide the immediate fate of 29 donkeys and Shetland ponies owned by the Gray family has today been adjourned.

A legal application was made this morning by James Gray of Spindle Farm, Hyde Heath, Amersham, Buckinghamshire for the RSPCA to immediately return 29 animals that they and other welfare charities have been caring for since police seized them in January 2008.

The application was made by James Gray after Deputy District Judge Kainth ordered that 11 donkeys and 18 ponies be returned to him by the RSPCA, at a hearing in Oxford Magistrates Court last Friday (4 April). The Society is yet to return the animals.

“We have very real concerns for the welfare of the donkeys, ponies and horses involved, and so have asked the District Judge to explain his decision,” said the RSPCA’s Chief Officer Tim Wass.

“Meanwhile, we will continue to care for the animals and explore all available legal avenues in order to secure their future welfare.”

Today’s hearing focused on points of law rather than the welfare of the animals. Speaking in the High Court this morning, Mr Justice Wyn Williams stated that he had to have regard to the proper legal procedure and so directed the Grays to instead address the matter to the District Judge.

Mr Justice Wyn Williams acknowledged that the RSPCA has formerly asked the Deputy District Judge Kainth to state his case and concluded: “by far the most appropriate person to enforce the order is the person who made the order”.
 
The pre-trial review for the RSPCA's criminal case against James John Gray, Julie Gray, Cordelia Gray and Jodie Gray along with a 15 year old male will be heard on 28 April 2008 at Oxford Magistrates Court. They face 12 charges related to section 4 and section 9 of the Animal Welfare Act 2006 and cover causing unnecessary suffering to and failing to meet the welfare needs of a total of 125 horses, ponies and donkeys, removed from Spindle Farm between 4 and 12 January 2008.
 
Yes BUT this is totally seperate from that case! This was a seperate application, which means they might get it back into court as early as Monday!
