Definitely not trying to bankrupt him hehe! And not us going bankrupt thankfully. The builder has lied and cheated us for months and still has a massive snags list and signing off/SAP ratings to sort, substandard work to pay for (for it to be redone) and payment for wrecking our hay field etc etc I could go on but I won't. Phoned him the other day as had heard nothing back after a letter sent by us (and OKd by our solicitor) stating we were getting legal advice, had a surveyor's report which basically condemned the work etc. He said he was unable to meet with us, wasn't sure if he should be speaking with us, was unable to complete any more work and lots of people owe him money but he owes lots of people money. It basically transpires that he's either in liquidation or receivership, though he is not hot on communication and we are still none the wiser as to what is going on, what this means for us. He landed us with an unfounded extras bill, of which half was either in original contract/price or he has not actually done and of the rest a lot if substandard or very very overpriced (even accounting for profit margins). Also, however many times we asked him he never issued extras bills or told us the cost of anything and actually we only had a very few small extras! He overran by 25 weeks at the time we called it a day and the house is still only just liveable. Plaster could sheet off the walls at any minute because a lot of it is hollow, there's cracks, patchiness, roughness. Building Inspector says the house does not even meet minimum regs. He's endangered our lives on more than one occasion, for example disconnecting the gas cooker and then reconnecting using the wrong connection, because he was too cheap to get the plumber to do it. When the plumber saw it a few days later he hit the roof and said it was a jolly good job we weren't cooking at the moment (due to state of house) as the house could have blown up and he's dealt with the aftermath of somewhere that did happen.
I could go on about the way he has treated us and his staff (he rarely pays them) and lots of other stuff, but I'd be here all day.
Is he a Limited Company? If so PM me the company name and co reg number and I'll have a look for you re their present insolvency status. If he is a sole trader I wouldn't be able to find anything unfortunately.
i can help if you want info on limited or sole trader. i also now a lot about construction and the federations that you should belong to. i also have used the county court claims system a few times. PM me if you want any advice
