Vosa are at it again

I'm in discussion with vosa about my old horselorry and the tachograph use rules, if you have a lorry that is more than 25 years old (historic status) and over the 7.5 tonne limit then it appears that you do not have to run under tacho rules, problem is that no one at vosa will stand up and give a definative 'yes you have to run under hours rules' or No you don't. Please write to them and ask them for clarification.

I asked them for clarification about the requirement for a written log when it's private use only; a charming man spoke to me on the phone and said he would research it and get back to me - never heard a thing. My HGV instructor told me they never get back to anyone on clarification questions as he has approached them with questions in the past. I'd be amazed if they get back to you.

That is correct Neddynosh, you don't have to run it under tacho rules as it's too old for a tacho, and therefore how can they prove the hours? Common sense would prevail I would imagine.

they have got back to me, with a four page letter, all it states is the stuff in the handbook they publish on drivers hours rules, and a cop out clause stating that the response is only an opinion( but no opinion was given) and that only a court can give the final interpretation on a point of law. Anyone Know a judge who would like to give an opinion?

sadly tacho's have to be retro fitted to All lorries over 12,000kg (yet another law snuck in 2007) there is no such thing as too old for tacho any more, or so Hastings Test centre told me.

I know its a mad,off the wall idea, but how about having a bloody tacho fitted and complying with the regulations that were brought in to protect the rest of us from cowboy drivers.

If VOSA decide to chase you on legal grounds, wait for the court to make a decision at that time...

Keep giving em ideas and questions and they'll only push it to enforcement!!

I have a tacho fitted and I am complying with the drivers hours rules, always have cos I also run under an O Licence. What I asked for was clarification from Vosa. I wanted to find out if everyone was singing from the same hymn sheet... It seems that everything is open to interpretation... or is that a grey area...
