Warning about Trailer Insurance.

Dear all

I feel that I have to share with you this information as I would not want
anyone to be placed in the same situation that I am. This story is true - I
am living through it right now - please feel free to pass it on to any
friends/contacts you have.

On 13/5/2011 our trailer was stolen from its parking space outside our
house. We immediately rang both the police and our insurance company. We
completed all the necessary paperwork and waited for our claim to be paid
out. Weeks later we were still waiting. We never received any direct
correspondence from the underwriters and the broker never returned my
frequent calls.

On 26th July I received a copy of a letter from the underwriter stating that
the insurance company had decided to void my policy "ab initio" and return
my premium. This is because, nearly a year after the policy was bought and
paid for, they have decided that they offered cover in error and are in
effect denying that the policy ever existed. They have returned my initial
premium (but not the interest on the payments) in an attempt to avoid
liability for the claim.

The underwriters' stance is that they assumed the trailer was parked in my
drive (which I don't have) despite the fact that their own recording of the
conversation shows me stating "it is kept in an off road parking spot. I
don't have a drive." And in fact then repeating this statement quite
emphatically. "it is an off road parking spot at my home address but as I
say it's not on a driveway or in a garage or in a barn because I don't own
such a thing." Their letter states that had I disclosed that the trailer
was parked in an off road space they would not have offered cover and that
by giving the information above I was misleading them into believing that
the trailer was stored on my drive. They have made no attempt to address my
complaint to them and refuse to enter into a dialogue about why they
interpret what I said in this way.

The broker has told me that he has now been advised that this company has a
policy (which is NOT in any policy documents) not to cover trailers whilst
in a "car park", which is what they have defined the residents parking area
of my street as. I find this very worrying as there are plenty of times at
events/rallies/camps when my trailer has been parked in a "car park" at an
equestrian centre or farm. I have had no assurance from the company that
they will cover trailers in such circumstances.

Now of course I am going to the Financial Ombudsman (and if I'm honest I
really don't think the company has a leg to stand on) but in the meantime I
am paying interest on a loan to replace my trailer and am having to deal
with an awful lot of hassle that I could well do without. If a reputable
and large insurance company can attempt to wriggle out of liability to me on
such an unbelievably flimsy excuse then I believe that they could easily do
it to someone else.

The broker in question is 4 Counties who have apologised to me verbally now
for the appalling service and actually have also stated on more than one
occasion that they believe my claim to be entirely valid. The insurance
company who underwrites the policy is Equity Red Star and unfortunately this
is the only trailer insurance which 4 Counties offer as they have a special
arrangement with them. Equity Red Star are a major underwriting company who
offer insurance products of all types, both in and out of the equestrian
market. I have now made sure that I have no other policies underwritten by
this company as I have no confidence at all in the protection their products
offer. What you choose to do with this information is up to you.......
 
Although I don't own a trailer I have friends that do so thank you for the heads up

I hope you get things sorted out, it is awful companies think they can do these things!!!

That's a bit of a nightmare! Poor you. I'm sure you'll eventually get your money back, but like you say... you shouldn't have to go through all this hassle. Good Luck.

Another thing worth noting for people with trailer insurance, a lot of policies also state it must be 'wheel or tow hitch' clamped when left unattended. Quite often this is in the small print of some polices and a lot of people don't realise.
 
That's ridiculous! They have every right to void your policy if you had lied and said it was kept on a driveway but you didn't.

They had the information, they made an offer and you took it. Therefore, they have to honour your policy and claim.

And as for things that aren't in the policy...! That policy is the terms of your contract, you can't add things to it! I work in insurance and this has made me really angry! Does your policy document say its not kept on a drive?

I had probs with Equine First last year (not paying out for a claim they'd already agreed); they spent months ignoring me and my letters but funnily enough, I received a cheque about 3 days after I'd written to say I had started proceedings with the FO.

Hope you get this sorted out. Insurance companies are such a bl00dy nightmare.
 
Plus, if you personally spoke to them on the phone then they should have recorded the call...although I'm not sure what your broker is getting comission on as they should have placed the policy for you and should be doing all the leg work!

Depends on the claim really. Insurance companies get charged if a case gets taken to the FOS, used to be around £400 but think it went up to £800?! And that is regardless of whether they take the insurers side or not. I used to work for one of the major equine insurers and if someone threatened to take action over a £1000 vet fee claim or death claim, they would normally 'give in' as they would end up having to fork out money anyway. However, if the trailer was insured for a fair amount and they are adament they are right, they may stick to their guns
 
What does it actually say in the policy? I am worried too - effectively mine is in a car park being parked at the yard.

Always, always read the small print on insurance docs when they arrive!

We have 2 cars, one parked in the drive, the other on the road. Insurance for the 'garden' car clearly states it is not covered if stolen within half a mile from my home, unless it is in the designated parking place as specified (driveway) - only found this out when reading it through a month or so after taking ins out - its a common thing for them to put in.

Hope you get it sorted out - and for anyone else - read the small print, please!

Have you tried the consumer action group forum, might be worth posting this in there as they have a wealth of knowledge on what to do in the situation you are in.
 
I am worried now as my policy is with the aforementioned company and parked in a farm yard, the address they have on the policy. It has 3 locks on (wheel clamp, coupling lock and hitch lock) plus datatag so I would be absolutely furious if they refused to pay out. Not sure if a driveway is mentioned so I'd better check. Hope you get sorted out.
 
I have a policy with SEIB and the excess just changes depending wher the trailer was stolen from - only thing I would say is I always put wheel clamp on at shows and if I load up to go for a hack just in case they use clause of not 'adequatly preventing loss'.

You sound like you are doing the right things so no advice other than take no crap and don't let them bully you! I've been through a nightmare (lasted 5 years) dealing with a crap insurance company. I turned physco bitch with them, took them to court and won.

They will no doubt try the old take it to court shite so be prepared to stand your ground and have no mercy! By taking your money they were excepting you as a customer. If they fecked up then thats their tough shite.

This is absolutely correct. When my trailer was stolen the ins refused to pay as i didnt have a receipt for the wheel clamp. Fortunately i was able to go to the retailers of clamp and get a duplicate receipt. I now have photographs of all security devices on the new trailer.
On checking our caravan ins i discoverd that the same applies.

Having had a vehicle stolen off our drive that had an alarm, steering lock and was chained to the ground, then I'm sure your man in the shop is correct. A wheel clamp is little more than an irritation to the average thief.

As someone who works in insurance I feel I have to say...hey! don't tar us all with the same brush! In a lot of cases people are annoyed at having claims refused as they simply haven't read the terms and conditions. By giving a premium you a re accepting those. Some companies (not naming names) are dodgy but others work within the rules!
 
Everyone nowadays SHOULD check the small print.

In this hard time of recession insurers are ducking and diving out of everything possible so as not to pay out.

Equity Red Star themselves are the underwriters for the equine recovery for SEIB and are towing horses still on the broken down lorry! So if they are ducking and diving out of that then not surprised they are not paying out for your trailer.

Would also get Start Farr at Laytons.com he is the horse and hound solicitor and comments alot in the magazine! Ask for his take on this and the legalities.

But I would advise EVERYONE to check their small print on everything! Saves a lot of heartache!
