my horse has had a horrific accident with wire fencing which was loose and not taught in her field at the livery yard i keep her at.... there has been several complaints about this fencing but as it this or nothing people have been forced to use it i am moving to a new yard as im very unhappy with many situations here but was wondering if i would have a legal case on this......... see pic on vet link main index bad leg injury......
 
Cant help you on legal aspects, I saw pics yesterday what a horrific injury,and hope that it heals ok, I think you would have to find a solicitor that deals with equines, do you have insurance to help with vet fees?
 
yeah i do have insurance but i need to take her for hydrotherepy which is covered for the treatment but not the 2wk livery which is £200pw also if i claim for injury in 12months time that leg wont be covered anymore just dueto there neglagence...
 
is there a problem with the fencing itself or is it just a nasty injury because the fencing is wire? we have had the same problem at my yard - it is wire and posts but then there is a line of electric sticking out on the top - i guess this is so that the horse gets shocked before it gets near to the wire, one of the mares was constantly getting her leg caught in the fencing and damaging herself badly due to stricking out through the fencing, if it had been tape then the injuries wouldn't have been so bad, however the YO showed her the fencing when she went there and I guess she accepted the fencing as part of the contract - therefore no leg to stand on (sorry for the pun!) however if the fencing is damaged/dangerous/not fit for purpose then you should be able to sue the YO, hopefully he will be insured or have some money in the bank to pay!!
 
have been at yard for well over a year without a problem as had fencing has been the thick green electric tape but have just been given this new paddock........ seemed ok till my horses field mate got wire stuck between foot and shoe which must of slacked it a bit then my horse rolled and got her leg caugt in it was told it would be repared but instead it was just twisted round so still v slack then this has happened........i do feel partly responcible as she is my horse and i knew it was dangerous but this was the only pad i was given i was hoping it would be fixed very soon
 
my god! I have just seen the pics! personally I would complain, if you are moving anyway then you can push as hard as you can. I would threaten legal action against the YO saying that you had cmplained before and the fence had not been repaired properly. I would also tell them that you are not only looking for all the vets fees paid for but also compensation, at the very least they might get worried and try to come to some arrangement. There are lots of names in the back of the H&H for legal issues I would definitely make contact, but in any case you might want to ask your YO for their insurance details!!
 
Did your horse get hurt BEFORE you knew about the wire, or after? If you were aware of it before turning your horse out that day, the YO cannot be held totally to blame.
 
I think if you knew about it and turned out anyway it is your responsibility but not sure, a friend of mines horse was injured very badly after going through an electric fence which the battery was not working on even though the yo had been informed about it the vets bill was huge, so my friend claimed and the insurance company the last i heard where going to sue the yo for it so not really sure where you stand, sorry havent been much help but if you are going to claim you insurance company may help!
 
Keekee - re the £200 livery for your ned that the insurance won't pay. When my ned needed hospitalisation it was a very experienced horse clinic and they explained they would break the livery charges down into nursing costs and "hotel" costs. Your insurance should pay the nursing costs, although probably not the "hotel". Hotel costs is for bedding, feed etc but your £200 might also include nursing stuff such as changing bandages, drying off under lamps etc etc etc. Worth asking them as the true "hotel" costs may shrink by £50 or so.
