When loaning a horse-should you or the owner have the passport?

Ive got a boy on loan whose injections ive just had done and the vet really wasnt impressed that i dont have his passport and says loaners usually do, especially if competeing.

Ive loaned before and never had a passport but now i do intend to compete, the owner was happy for him to do BSJA, endurance and BE :0 and i know i need his passport to do this but im not conivinced ill get it

Theres nothing in the contract about the passport.

Whats the norm???

By law the passport has to stay with the horse. Even on the yard if they were to come and check, you'd have 2 hours to get it or a fine. You absolutely cannot travel a horse without a passport - £1000 fine for the driver I believe.
 
I loan and I have the passport.
It was my understanding that the passport should stay with the horse and so you, as keeper have it so it is available for inspection if necessary.
 
It definitely has to stay with the horse so should be with you. NB its 4 hours not 2 that is the required period within which you have to produce it if stopped. Esp important if transporting the horse anywhere.

If the owner is concerned about you wandering off with the horse then they should be aware that having the passport wont stop that as it isnt proof of ownership.

Surely theres a loan agreement that makes it clear they are the owner anyway.

It def needs to be sorted as vaccs etc may be refused if vet cant have access to PP
 
i had a pony out on loan with its passport

the girl sold him and i found out when i saw his new owner ( a producer) had advertised him for sale.

she was still emailing me about him, pretending he was there

i would never loan a horse again and hand over his passport
 
my pony is out on loan 5 minutes down the road to a good friend, i have the original passport and she has a photocopy of it, it's me who transports the pony to shows anyway.
the reason we've done it like that is because the person who is loaning is prolific at losing things like that. she knows she can come to the house to get it if needed.

when i loaned my last mare i was given the passport, i kept the passport at home but a photocopy was kept at the yard. more a case of backup than anything else as you still need the original to be stamped for vacs.
 
By the law the passport has to stay with the horse. It is not proof of ownership however, if the owner is worried you may try to sell the horse on etc. Or can be done as riding_high has, with loaner having a photocopy, but the driver having the real passport for travel.

You will need it to travel. I once had a mare on loan but the owner had lost her passport. Our yard organized a trip to the beach. I could not go without a passport as the driver was worried that if he was stopped and checked, then he would be given a rather large fine.

This exactly!

2 of my boys are out on loan, both with passports. I trust my loaners 110% with my horses that they wouldn't sell them, otherwise, they wouldn't have them on loan!

If either needed to get to a vets in an emergency, then I would want the vet to check the passport for anything written eg allergies, before performing any kind of treatment

I gave loaner passport so they can go to shows and fun days out for transport, also any vacs to be noted by vet. Just phone and ask if you can get passport and you will sign updated contract stating even though you have passport, you are not the owner.

Ive got a section A on loan here with me,as companian,and like you I do NOT have the passport,as so called owner has refused to give it too me,and has lied about ownership too. I cannot find out if she has a passport as I do not actually know if this person is actually the real owner or whether she loaned it to me on false protences.Had the pony neally 6 years and DEFRA not interested.
 
If you don't trust the loaner with the passport, do you really trust them with your horse? You shouldn't be loaning a horse to anyone you don't trust and have solid ID from, if you ever want to see that horse again, regardless of the whereabouts of the passport.

Good point there. Ive got this pony on loan till payed for (no dates as to when to be payed by),woman refused to give passport. Doesnt come to see pony,nor ask about her. She used to email me all the time,demanding and threatening me,so I went to CAB and they sent me to see a solicitor. Dont hear from the woman now.
Pony is fine,happy as larry with her mate (from same owner,I bought him).
Problem is when you dont have a passport you cant insure the animal.
