Ok long story short

moved horse to full livery stables.

since being there i have been bringing my horse in pretty much every night even though yard manager see's me coming and is starting to get the horses in or in the process of it them. im pretty much left or asked to get my horse in then completly finish my own horse off even though ive paid for full livery and just want to turn up to ride!

the past 3 week my horse hasnt been there as been to a rehab clinic (long story)

im wanting to move yards to go back to diy and have found a place and want to give my notice. where do i stand with payment as i would like to go in two weeks as im more a less half way through the month but have still payed her for the full livery for this month even though horse isnt there do i really have to give her another half a months money? even though my horse will not be going back will be going straight to new stables. and hasnt been there for some of last month and this whole month.
 
Did you sign a contract for your livery? If so, what notice did it say you had to give? I'm afraid if it says 1 month's notice then you will have to pay the extra couple of weeks. If there is nothing to say how much notice you must give, then I would simply inform them that you will not be bringing your horse back.

If you have no contract there is not a lot they can do.
 
It depends how your written contract is worded? However if you have requested a service then you would have to pay for it (unles of course it was not provided).
If there was not a written contracrt then it is possible to claim that there was a verbal contract provided there where witnesses to what was said.
I would suggest that you contact the BHS legal help line. If you are not a BHS member join the BHS as a Gold member to get access to this service.

To be honest it depends on the YO.

I would talk to the YO and offer something reasonble. Then go from there.

...If it was me, and I had to give an additional 2 weeks notice after I had left as they require a month's notice, I would ask the YO if they would accept the cost for DIY for those two weeks as opposed to Full livery costs. See how it goes, you can only ask.

Give them a time you want your horse in by - then it should be in and ready for you.

As for moving, give a months notice and move.

Well you moved the horse so that's not the yards issue, as for the bringing in did you say to them I will be here at X to ride can you make sure he's ready after the first time you had to do it yourself if not I can't see why you would expect a reduction.
 
If the contract was for full livery and you didn't get it the YO is in breach so you can rescind. i.e. contract becomes void so you can move on and get refund. In reality try to negotiate amicably with YO in the first instance.
 
As a YO, it pains me to say it, put at the end of the day, there is little or pretty much nothing that the YO will do to get the money from you. Your horse isn't there, nothing stops you getting your tack and just leaving :o You might get a bit of a bad name, but that's about it, unless you have REALLY trodden on the YO's toes and they will sue you, but it rarely is worth the hassle over 2 weeks livery fee.

It sounds to me like a null and void point to be honest, and one that you should have raised with there and then if you weren't happy, and certainly seperately to leaving. I get the impression you would have received full livery if you weren't up there to ride, and that there was no agreement that your horse would be in and tacked up by X o'clock on the days you went to ride. Am I missing something :confused: If you were unhappy being asked to do that, why not just say at the time "I'm sorry, not got the time to help you out today, are you okay to do him?"

Finishing him off on those days would involve what, feeding and haying, possibly skipping out and rugging. Even the deluxe full liveries at the yard I work on feed and skip out if they have been riding and e.g. it would be inconvenient to them or a health risk to their horse to come straight back into a stable with hay and feed.

Just negotiate with the YO - if you are both reasonable you are likely to come to an agreement. If it were me I would negotiate along the lines of:
  • I'm going to move to a DIY yard when X comes back from rehab, is 2 weeks notice okay?
  • No? Oh, well, its just that you've had a full month's full livery upfront from me, and whilst I appreciate you wouldn't have been able to fill his stable, he hasn't actually been here using consumables and your grooms have been able to spend the time they would have spent on him doing other things. I really do think two weeks is reasonable given the circumstances.
  • No? Okay, I will offer you X to settle the cost of renting the stable (DIY rate) for another two weeks, If you don't fill it before then.
