Where will she stand legally?

If she has the yard postcode then she should be able to look it up on google maps, and go to satelite view and look for the yard that way. Sadly very foolish not getting enough contact details.

Pixie, just saying I REALLY REALLY hate your signature. Do you have to keep it? It's not even funny. If you do no bother. Just asking. :-)

Person has history/family history of bad credit/non-payment and may not be as experienced/knowlegable/concerned about welfare as presented to OP when original transaction agreed. Possibly acquired to sell on. May be able to find address of yard if required. PM if further info needed.

Having done a quick google of the area there are 2 yards that the pony might be at
1) Valesmoor Farm Telephone 01425 614487

From Valesmoor Farm

'We are an DIY Livery Yard, We are NOT a riding school and we are unable to offer riding lesssons to the public. We are also a Caravan and Motorhome Club Site, we have hook-up points for caravans and motorhomes and we have other facilites available. Our members can find more details on the club website.'

2) Sims Cottage Stables Telephone 01425 612961

Certainly will not be at Burley as that is full livery. Best bet is Valesmoor Farm IMHO.

I would be contacting them ASAP as hopefully they would not want what effectively is a stolen pony on their yard.

Personally,I would be very careful about contacting the yard where the pony could be.The yard owner could easily tell the person that somebody has been in contact trying to locate a pony of that description and her name and they move the pony on and then nobody would have any idea where it is.The owner is sadly going to have just make there way up there with transport and hope that it’s at any of those yards.I would also be very careful how many details are put on here, the horse world in particular is a very small world especially when something like this happens!.

Forgive the silly question but why would you send a horse away on loan without knowing where it was going? Especially with such a low deposit and to someone who is struggling with money so much she needs UC? It sounds very odd and I hope it all works out for the pony!

Universal credits were unknown until she pleaded poverty. Yes .. it’s a mess. Owner is lovely. Was too trusting. Was an agreed trial. With view to buy. Unfortunately, mistakes were made. Hindsight and all that. Let’s hope she pays the 100 pounds tomorrow with rest due on the 10th July. X

I put my hand up and say I’m on benefits due to my mental health. However my life is a such that robin wants for nothing and in fact gets far more than he needs. I go without rather than him!

That said if I was struggling to pay the extra £500 for the horse I would have to think if I could actually afford it really.

Same here. Being on benefits wasn't what I was getting at xx
Personally I'm questioning the fact that buyer is claiming poverty but seller is still OK for her to buy the horse/pony.

Yeah, I'm a bit suspicious too about whether or not the girl will cough up the money. Now that you are on her tail, she needs more time to move the horse.

(I hope that's not the case.)

Ok. Girl has promised 100 pounds tomorrow and the rest on the 10th July. Watch this space.
If I understand correctly at the moment the horse is on loan with a view to buy and has paid a £100 deposit.
This means that if she decides not to buy she can return the horse. Once the owner accepts a payment schedule then the pony is sold and the owners only recourse for non payment is the small claims court.

What she should be saying is that the buyer needs to pay balance in full otherwise the loan is ended and the horse should be returned. The deposit should be returned if the horse is returned, otherwise if the owner has to collect then the deposit will be forfeited.

The thing which would worry me most of all is not knowing exactly where in the world my horse was. I would have thought that would be a basic piece of information to have acquired before letting it go on this loan wvtb. The other niggle would be how well cared for it's going to be, given that the potential purchaser is struggling to find the balance. (or says she is.) I'm sure the girl has been too trusting which we're all guilty of sometimes but this all sounds a bit irresponsible, sorry!

Some people are astonishingly naive and just ask for trouble! The only practical question is whether the seller is prepared to sell the pony for £100. If she is, leave it and if any more money turns up that is a bonus. If she isn't, she needs to go and collect the pony now without warning (if she thinks she even knows where it is). Poor pony with such feckless people to care for it!
