Hey I'm new!!!!
Quick question.......
If you have a horse on loan then who keeps the passport and vaccination records the owner or the keeper?? Because you have to be able to provide it within 3 hours(I think ) but I live over a 2 hourdrive away from the owner of my horse so wouldn't be able to provide it quickly if she had it. Would a photocopy do??
Same thing at competitions really because you need them when you give your start fee at most BE's but its a pain posting it back and forth ( and gets expensive as have it sent recorded delivery ) i understand why my ownerwants to keep it as its her proof of ownership. VEERY confused help please

As far as I am aware, it isn't proof of ownership anyway. She should have a reciept to prove purchase.

I take our passports everytime we travel, even if its just to hack out somewhere different. You are right, you need to produce it as and when.

The passport has to be held by the keeper of the horse. Some PIO now issue a document that is used as a proof of ownership and this is kept by the owner and is used to show change of ownership in France and Germany it is part of the law.

I've changed my mind on this recently - I have always let the passport go with the horse in the past when I have loaned the horse out, but now I will not let the loanee have the passport. I have spent a lot of money in the last year replacing passports that were lost by the loanee! Now I give them a photocopy of the key passport pages, and if they are attending an event, vet or something similar that they need the passport for, I will let them take it for that period of time, but it must be returned afterwards. It's all well and good getting them to sign a contract saying they will replace the passport/tack if lost of broken, but actually managing to get payment is another issue entirely!

Erm, I'm under the impression that horse and passport should be together. Not sure how I'd feel if i was loaning one and the passport didnt come with the hoirse...

I understood that law to say the passport has to be where the horse is unless you are out hacking in which case you have three hours to produce it. This does mean that the passport should be at the livery yard with the horse, or in the box if travelling. I don't know if photocopies will do we've always had to provide the origional.

I have my mare on full loan - and the owner wants me to pay for vaccinations etc which means i have to have the passport .. but when the vets been she takes it again .. but she said shes going to give it to me in the new year with the new contract etc. But this is stil yet to happen. I do wish I had the passport though because if i get stopped then I wont be happy lol .. x

Just to throw a spanner

If a loaner (not saying they would btw

) has the passport, what stops them from selling the horse on?

I thought passports were to prevent unlawful sellings (not that I believe passports to be worth their weight in card!)

if you don't trust the loaner with the passport, do you really trust them with your horse ( which is presumably worth FAR more than a passport)?

I have my mare on loan, and i have her passport. Her owner has copies of my passport and council tax bill to prove I am a real person and that I live where I said i do.

The passport is just an identity booklet (if you like) that belongs with the horse-it does not in ANY way prove ownership. Passports were introduced so that WE the UK horse owning public could still continue to medicate our horses on bute etc. Passports were introduced so that the horses that are on bute DO NOT enter the food chain.

IF you are loaning the horse then the passport MUST go with the horse and stay with the loanee. If you are the loaner then your contract will state what/who is responsible for what rugs, tack, insurance etc. You would also stipulate who is to pay for any 'damage/loss' to the said equipment and I would state that passports are under this.

Trading Standards are not allowing any lea way on this-£5000 fine! Lets not give this government any more money!

At the end of the day ANY one can get a new passport for the horse regardless of who the owner is!

totally agree with foraday, i had this discussion with DEFRA over the phone as i had a loan horse and the owner refused to give the passport over, and everything foraday has said is what DEFRA said!
i could not compete the horse (even though she wanted me too) as i couldnt travel without the passport and if you get caught you have 3 hours to produce it! my horses owner lives more than 3 hours away!
i eventually got it in the end, but passports DO NOT prove ownership, its jsut the identity of the horse. and if you do not trust your loaner to have it should you really trust them with your horse???
