Who will be liable for this mess ?

House contents insurance generally covers stuff like your dog causing an accident.

And horses, but it often excludes hunting (bizarrely sometimes only drag hunting!)

I hope to goodness the girl with the dead horse is insured for third party.
 
Well, yes. But what's annoying is the palava of having comeone claim off your insurance and it affecting your future insurance premiums over the next 3 to 5 years. Even if it's deemed a non-fault accident on your file - it STILL affects your future premiums if you are involved in any sort of accident - at fault or not. Okay, so eventually you aren't financially out of pocket, but you're still left with a stain on your record because of some other idiot's mistake. THAT'S what hacks me off about the current way claims are handled! ��


On Tuesday of this week a friend was stationary behind another car waiting for the car in front of that to turn right. A Mercedes sprinter van hit them from behind and they ran into the car in front. Their insurer is Tesco.

They are claiming off the Mercedes. The car they hit is claiming off the Mercedes. No-one is claiming off my friends, as the accident was not their fault.

This is exactly how I believed things were done in that situation. I know other people have had claims handled differently, as reported above, but clearly it isn't always done that way when liability is clear cut.
 
The whole liability and fault thing you can be liable for something that's happened when you are blameless .
Like the whole loose horse and strict liability for third party injury thing if you horses is let out by vandals and causes injury to a third party you will be always liable even if you could have taken no steps to prevent the accident happening.
