Yet Another e bay question

OH bought a second hand DVD player and surround system off eBay over Christmas. It is exactly the same as the one we currently have as all we need is the DVD player as ours doesn't play DVDs any longer. Seemed a good idea as then we don't have to mess with the speakers or anything.

Package arrived yesterday. Neighbour signed for it as we were at work. When we took the DVD player out of the box it was damaged. A rather large dent in the top right hand corner. DVD player was in the bottom of the box. Packaging itself was fine. Pictures on eBay didn't show any signs of damage at all. We can only presume therefore that the package has been dropped or something.

When we plugged in the player there was no power at all. Tried the same lead with our existing DVD player and that had power, so it's not the lead.

Have contacted the seller who has asked for photos of the damage and of the packaging. Also asking if when delivered we were given a receipt saying box was damaged (we had no receipt at all, but of course, box was not damaged)

So, where do we stand? Looks like player has been damaged in transit, but packaging itself OK. Feel really Bad for the people we have bought it off, but as we only wanted the DVD player anyway, the rest of the contents are no good to us and ideally we want our money back as goods didn't arrive as described.

Any suggestions welcome.
 
Thanks jingle Jools. Sent photos last night, so now waiting for them to come back to us. Item description says no refunds, presume that doesn't count if goods not in condition described?
 
I bought some crockery and one plate was broken in the set, obviously happened in transit as box was bashed. Took pictures, sent to seller, they offered to go halves to buy another plate (from a diff ebay seller who had one), I explained they can claim on courier for full amount, they did and refunded me for the full amount of the replacement plate :) Hope this helps a bit
 
open a not as described case & ebay will ask you to send back but this will be at your own cost & must be sent via tracking. seller may refund you your postage costs but not obliged to. then you will recieve what you paid for the dvd. how was the item sent? can seller claim damage from courier?
