YO advice on evicting a livery.

If you've done all the above including recorded delivery letters.. Put up an abandonment notice stating that if the horse is not removed and all monies owed paid then it will be sold after 3 weeks. Then sell it.
 
I've known of liveries been kicked off with a weeks notice, no letters etc, just told to go, and given a week to find somewhere else (coincidentally, YO would ring around and put other yards off if it was money related) he hadn't informed..
 
Without going into too much detail is there someone/somewhere you can take the horses until the matter is settled?
We have had occasion to remove a horse from the yard to 'an undisclosed location' until money was paid to our solicitor.
Also I would advise using a solicitor straight away than faffing about with small claims court, CCJ's are not that easy to enforce and are only worth it if you want to wait 12 months for your money and then receive it at £10 per week!
 
whilst it is wrong and sad that the owner owes back livery, it is also sad and unfair that a horse/horses should suffer and be left tied up somewhere or even other yards being informed about bad livery money due so that the owner has no where to take the horse, so what does the owner do with the horse - shoot it!!

Okay I know its not your problem as they owe you money, but it also isnt the horses problem, can't you speak to them and try to find a way to get the money owed whilst they are still at livery with you, obviously they have not left because maybe they have no where to go.

Right, the truth of the matter is it is not as easy as some of your readers make out. I rang BHS solicitors through my gold membership and they rang me back later that day. You must write a letter of notice according to the terms in your contract, if they dont have a contract you should give a reasonable notice time this time is up to you in essance but it has to be reasonable.

If they stay longer you must write another letter stating your intention to go to court however it wont be a case of the bailiffs turning up it just doesnt work that way in law.

You could end up with them there for weeks and thats the fact of it.

What you can do is stop them using any of your facilities including paddock and school and stable as they are your facilities but you cannot forcably evict them. You can increase the livery fee but bear in mind the moment you take money from them they can stay longer as theyve paid for it. You have to make it so uncomfortable for them (but not at the expence of the horse) as you have a duty of care if they are on your yard to the horse.

I know you have been given some gun hoe advice but legally the law is NOT in your favour you have to play this cleverly.

I am lucky my livery did eventually sod off (thank goodness). and is now on a yard where the livery owners are completely incompetant, stupid and people who I cant stand, so they suit each other to the ground, LAST LAUGH ON ME HA HA HA

Where are you getting your advice from???? you cant do that its a live animal not a broken down car,for Goodness sake.

It is legal to do this provided the correct route has been followed.
The owner must not be barred from their animal tho. More used in cases where owners abandon their animals in livery yards or just dont turn up for a fortnight or more........

I am entirely serious! That's what we did and we got our outstanding bill (in excess of £2.5k) settled within a week paid in cash at our solicitors office, horse was then collected at a prearranged time and day and removed by somebody on behalf of the owner.
